ENROLLED ACT No. 372 2017 Regular Session HOUSE BILL NO. 450 BY REPRESENTATIVE ABRAMSON 1 AN ACT 2 To amend and reenact R.S. 33:9091.12(D)(1)(a) and (F)(2) and (4), relative to the Upper 3 Audubon Security District in Orleans Parish; to provide relative to the governing 4 board of the district; to provide relative to the parcel fee levied within the district; to 5 provide relative to the amount, expiration, and renewal of such fee; and to provide 6 for related matters. 7 Notice of intention to introduce this Act has been published 8 as provided by Article III, Section 13 of the Constitution of 9 Louisiana. 10 Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 33:9091.12(D)(1)(a) and (F)(4) are hereby amended and reenacted 12 to read as follows: 13 §9091.12. Upper Audubon Security District 14 * * * 15 D. Governance. (1) The district shall be managed by a board of 16 commissioners, referred to in this Section as the "board". The board shall be 17 composed as follows: 18 (a) The president of the Upper Audubon Association or his designee. 19 * * * 20 F. Parcel fee. 21 * * * 22 (4)(a) A fee shall be imposed only after the question of its imposition has 23 been approved by a majority of registered voters of the district voting on the 24 proposition at an election held for that purpose in accordance with the Louisiana Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 450 ENROLLED 1 Election Code at the same time as a regularly scheduled primary or general election 2 in the city of New Orleans. The amount of the fee may be changed by duly adopted 3 resolution of the board, not to exceed the maximum amount authorized by this 4 Subsection and approved by the voters. No other election shall be required except 5 as provided by this Paragraph. 6 (b) The fee shall expire at the time provided in the proposition authorizing 7 the fee, not to exceed six seven years from its initial imposition, but the fee may be 8 renewed as provided in Subparagraph (a) of this Paragraph. Any election to 9 authorize the renewal of the fee shall be held only at the same time as the mayoral 10 primary a regularly scheduled election for in the city of New Orleans. If renewed, 11 the term of the imposition of the fee shall be provided in the proposition authorizing 12 such renewal, not to exceed eight seven years. 13 * * * 14 Section 2. R.S. 33:9091.12(F)(2) and (4)(b) are hereby amended and reenacted to 15 read as follows: 16 §9091.12. Upper Audubon Security District 17 * * * 18 F. Parcel fee. 19 * * * 20 (2) The amount of the fee shall be as requested by duly adopted resolution 21 of the board. The fee shall be a flat fee per parcel of land not to exceed five seven 22 hundred dollars per year for each parcel. 23 * * * 24 (4) 25 * * * 26 (b)(i) The Except as provided in Item (ii) of this Subparagraph, the fee shall 27 expire at the time provided in the proposition authorizing the fee, not to exceed seven 28 years from its initial imposition, but the fee may be renewed as provided in 29 Subparagraph (a) of this Paragraph. If renewed, the term of the imposition of the fee shall be provided in 2 the proposition authorizing such renewal, not to exceed seven years. 3 (ii) If the voters authorize a maximum fee in excess of five hundred dollars 4 per parcel of land as authorized in Paragraph (2) of this Subsection prior to January 5 1, 2026, then such fee shall expire on December 31, 2026, but the fee may be 6 renewed as provided in Item (i) of this Subparagraph. 7 * * * 8 Section 3. Section 2 of this Act shall become effective on January 1, 2019; however, 9 the board of commissioners of the Upper Audubon Security District may call an election for 10 the purpose of submitting the question of the imposition of the fee authorized by Section 2 11 of this Act to the voters prior to January 1, 2019. 12 Section 4. Sections 1 and 3 and this Section of this Act shall become effective upon 13 signature of this Act by the governor or, if not signed by the governor, upon expiration of 14 the time for bills to become law without signature by the governor, as provided by Article 15 III, Section 18 of the Constitution of Louisiana. If this Act is vetoed by the governor and 16 subsequently approved by the legislature, Sections 1 and 3 and this Section of this Act shall 17 become effective on the day following such approval.
