HOUSE BILL NO. 46

POLICE/MUNICIPAL:  Provides relative to the personnel authority of the police chief in
Amite City
1	AN ACT
2To amend and reenact R.S. 33:423.17, relative to the Amite City Police Separtment; to
3 provide that the police chief shall appoint, promote, discipline, and discharge police
4 personnel subject to limitations; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article III, Section 13 of the Constitution of
7	Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 33:423.17 is hereby amended and reenacted to read as follows:
10 ยง423.17.  City of Amite City; disciplinary action authority over personnel by elected
11	chief of police
12	Notwithstanding the provisions of R.S. 33:423 or any other law to the
13 contrary, in and for the city of Amite City, the chief of police may take whatever
14 steps are necessary to effect disciplinary action concerning police personnel,
15 including but not limited to the suspension of police personnel. Any such
16 disciplinary action shall be taken without regard to race, creed, or color shall appoint,
17 promote, discipline, and discharge police personnel subject to the budgetary
18 limitations of the mayor and town council pertaining to the number of allotted
19 positions for the police department.

Abstract:  Authorizes the Amite police chief to appoint, promote, discipline, and discharge
police personnel.
Present law, applicable to most Lawrason Act municipalities, provides that the elected police
chief makes recommendations to the mayor and board of alderman regarding the
appointment, promotion, discipline, and dismissal of police personnel. Provides that the
mayor and alderman are responsible for taking these actions with regard to police personnel.
Present law, applicable to Amite, authorizes the police chief to take whatever steps are
necessary to discipline police personnel. Proposed law provides for the police chief to
appoint, promote, discipline, and discharge police personnel subject to the budgetary
limitations of the mayor and board of alderman pertaining to the number of allotted
positions.
