ENROLLED ACT No. 350 2017 Regular Session HOUSE BILL NO. 495 BY REPRESENTATIVE JIM MORRIS 1 AN ACT 2 To authorize and provide for the transfer of certain state property; to authorize the transfer 3 of certain state property in Bossier Parish; to provide for the property description; to 4 provide for reservation of mineral rights; to provide terms and conditions; to provide 5 an effective date; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. The commissioner of administration and the secretary of the Louisiana 8 Department of Health are hereby authorized to enter into such agreements, covenants, 9 conditions, and stipulations and to execute such documents as necessary to properly 10 effectuate any conveyance, transfer, assignment, lease or delivery of title, excluding mineral 11 rights, to the property described in Section 1 of this Act, and as more specifically described 12 in any such agreements entered into and documents executed by and between the 13 commissioner of administration, the secretary of the Louisiana Department of Health, and 14 the Arc of Acadiana, in exchange of consideration proportionate to the appraised value of 15 the property. A condition of the conveyance of property authorized by this Act shall be that 16 in the event the Arc of Acadiana decides to sell, convey, or transfer the property described 17 in Section 1 of this Act the state shall have a right of first refusal to purchase the property. 18 Section 3. This Act shall become effective upon signature by the governor or, if not 19 signed by the governor, upon expiration of the time for bills to become law without signature 20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 21 vetoed by the governor and subsequently approved by the legislature, this Act shall become 22 effective on the day following such approval.
