HOUSE BILL NO. 617

DISTRICTS/PUBLIC IMPROVE:  Provides relative to District Five Road Commission of
St. Landry Parish and District Six Road Commission of St. Landry Parish
1	AN ACT
2To amend and reenact R.S. 48:600.1(B)(1) and (4) and 600.2(B)(1) and (4), relative to
3 district five and six road commissions of St. Landry Parish; to provide relative to the
4 appointment of the commissioners of the boards of district five and six road
5 commissions of St. Landry Parish; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 48:600.1(B)(1) and (4) and 600.2(B)(1) and (4) are hereby amended
11and reenacted to read as follows:
12 §600.1.  District Five Road Commission of St. Landry Parish

14	B.(1)  The commissioners of the board shall be appointed by the governing
15 authority of the parish of St. Landry.  The governing authority shall appoint one
16 member from each of the thirteen precincts precinct within Police Jury District Five.
17 as such districts are established at the time the appointments are being made and as
18 certified by the St. Landry Parish register of voters.  who Each member appointed
19 shall be a resident of such precinct. the precinct he is appointed to represent.  The

1 governing authority of the parish shall attempt to achieve a racial balance when
2 appointing the commissioners to the board.

4	(4)  The terms of commissioners of the board appointed upon the expiration
5 of the initial terms shall be two four years, and upon expiration of a term of office,
6 the successor shall be appointed as provided in Paragraph B(1) of this Section
7 Subsection.  No commissioner shall serve for more than two terms.  No person who
8 has served as a commissioner for two consecutive four-year terms shall be appointed
9 for the succeeding term.

Abstract:  Provides relative to the appointment and terms members of the District Five
Road Commission and District Six Road Commission in St Landry Parish.
Present law creates the District Five Road Commission and the District Six Road
Commission in St. Landry Parish, each having boundaries coterminous with the respective
police jury district. Authorizes the districts to construct, acquire, operate, and maintain roads,
bridges, and road drainage facilities and, subject to voter approval, to levy a sales and use
tax of up to 1%. Proposed law retains present law.
Present law provides for the appointment of members of each commission by the parish
governing authority. Requires the appointment of one resident of each precinct comprising
the respective police jury district. Provides for appointment of members from the 13
precincts in district five and six precincts in district six.
Proposed law retains present law except to remove the reference to a specific number of
precincts in each district and to provide instead for appointment of a member from each
precinct as they exist at the time of the appointment.
Present law provides for two-year terms for members of the road commissions. Proposed law
changes the term of a commissioner to four years and prohibits serving more than two terms
consecutively.
