MEDICAID:  Memorializes the U.S. Congress to authorize investigation and prosecution
of Medicaid recipient fraud by state Medicaid fraud control units
1	A CONCURRENT RESOL UTION
2To memorialize the United States Congress to take such actions as are necessary to amend
3 Title XIX of the Social Security Act relative to the Medicaid program in order to
4 authorize state Medicaid fraud control units to investigate and prosecute Medicaid
5 recipient fraud.
6 WHEREAS, the annual cost of Louisiana's Medicaid program has grown to
7approximately eleven billion dollars; and
8 WHEREAS, the Medicaid program  continues to grow at an increasing rate and now
9encompasses well over one third of the operating budget of this state; and
10 WHEREAS, Louisiana has expanded its Medicaid program in accordance with
11Public Law 111-148, the Patient Protection and Affordable Care Act; and
12 WHEREAS, actual enrollment into Louisiana's expanded Medicaid program has
13exceeded initial projections by over one hundred thousand enrollees; and
14 WHEREAS, the Louisiana Legislative Auditor has determined that a number of
15persons who enrolled in Medicaid were not eligible for benefits of the program; and
16 WHEREAS, this state currently does not police Medicaid recipient fraud effectively;
17and
18 WHEREAS, the Medicaid Fraud Control Unit within the office of the attorney
19general has the capability and expertise to investigate Medicaid recipient fraud and prosecute
20cases of such fraud; and

1 WHEREAS, Medicaid fraud control units such as that of the Louisiana attorney
2general are currently prohibited by provisions of Title XIX of the Social Security Act from
3conducting investigations into Medicaid recipient fraud; and
4 WHEREAS, the office of the attorney general is the only Louisiana law enforcement
5division with statewide jurisdiction that has the necessary expertise and capability to
6investigate and prosecute Medicaid recipient fraud; and
7 WHEREAS, though this state has an indisputable interest in investigation and
8prosecution of this form of Medicaid fraud, these actions are prohibited under the Social
9Security Act.
10 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
11memorialize the United States Congress to take such actions as are necessary to amend Title
12XIX of the Social Security Act relative to the Medicaid program in order to authorize state
13Medicaid fraud control units to investigate and prosecute Medicaid recipient fraud.
14 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
15presiding officers of the Senate and the House of Representatives of the Congress of the
16United States of America and to each member of the Louisiana congressional delegation.
