1	AN ACT
2 To amend and reenact R.S. 11:102(D)(3)(a), R.S. 17:374(A)(2)(g), 419.2(A), 1815(A) and
3 (C)(4), the heading of Part II of Chapter 8 of Title 17 of the Louisiana Revised
4 Statutes of 1950, 1962(2), 1963(A), 1964(A)(15), 1968.1(A)(1) and (B)(1), 1970.1,
5 1970.3(A), and 1970.9(A) and (E), R.S. 36:651(Q), and R.S. 39:98.3(C)(2) and
6 467(B)(2), relative to renaming the Louisiana School for Math, Science, and the Arts
7 as the "Jimmy D. Long, Sr. Louisiana School for Math, Science, and the Arts"; and
8 to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 11:102(D)(3)(a) is hereby amended and reenacted to read as follows:
11 §102. Employer contributions; determination; state systems

14	(3) The provisions of this Paragraph and Paragraphs (4) through (9) of this
15 Subsection shall be effective for the June 30, 2011, system valuation and beginning
16 Fiscal Year 2012-2013. For purposes of this Subsection, "plan" or "plans" shall mean
17 a subgroup within the system characterized by the following employee
18 classifications:
19	(a) Employees of an institution of postsecondary education, the Board of
20 Regents, or a postsecondary education management board who are not employed for
21 the sole purpose of providing instruction or administrative services at the primary or
22 secondary level, including at any lab school and the Jimmy D. Long, Sr. Louisiana
23 School for Math, Science, and the Arts.

4 §374. Quality Science and Mathematics Council; creation; membership; terms;
5	vacancies; domicile; meetings; compensation

7	(2) The council shall be comprised of one member of the State Board of
8 Elementary and Secondary Education selected by the board, two members from the
9 state Department of Education appointed by the superintendent of education, and two
10 members of each of the following organizations chosen by the organization:

12	(g) The Board of Directors for the Jimmy D. Long, Sr. Louisiana School of
13 for Math, Science, and the Arts.

15 §419.2. Extra compensation for school support personnel
16	A. All noncertificated support personnel employed by city, parish, or other
17 local public school systems and noncertificated, unclassified support personnel
18 employed by the Louisiana School for the Visually Impaired, the Louisiana School
19 for the Deaf, the Louisiana Special Education Center, the Jimmy D. Long, Sr.
20 Louisiana School for Math, Science, and the Arts, the Southern University Lab
21 School, the Louisiana State University Lab School, the New Orleans Center for the
22 Creative Arts, the special school districts, the office of juvenile justice in the
23 Department of Public Safety and Corrections, and nonpublic lunchroom employees
24 eligible for state salary supplements shall be paid by the state extra compensation as
25 provided in Subsection B of this Section. The annual state extra compensation shall
26 be paid only to those support personnel not paid exclusively from federal funds.

28 §1815. Louisiana Hall of Fame for the Arts; Northwestern State University; creation
29	A.  There is hereby created the Louisiana Hall of Fame for the Arts which
30 shall be located at the A. A. Fredericks Center for Creative and Performing Arts at

1 Northwestern State University at Natchitoches and which shall be under the joint
2 sponsorship of Northwestern State University and the Jimmy D. Long, Sr.
3 Louisiana School for Math, Science, and the Arts.  The hall of fame is established
4 to honor and provide suitable recognition to native and resident Louisianians who
5 have demonstrated meritorious development and achieved statewide, national, and
6 international acclaim in the creative and performing arts, namely, dance, music,
7 theater/film, and visual arts.

9	C.  The election board of the hall of fame shall be composed of nine
10 members, all representative of the arts named above, who shall be appointed by the
11 governor for terms of five years, except that in making his initial appointments, the
12 governor shall appoint one member to serve for a term of one year, two for two
13 years, two for three years, two for four years, and two for five years. The board shall
14 include representation from the following:

16	(4)  A representative of the Jimmy D. Long, Sr. Louisiana School for Math,
17 Science, and the Arts and a representative of Northwestern State University, who
18 shall serve as cochairpersons of the board.

20 PART II.  JIMMY D. LONG, SR. LOUISIANA SCHOOL OF FOR MATH,
21	SCIENCE, AND THE ARTS
22	*          *          *
23 §1962.  Definitions
24	As used in this Part, the following words, terms and phrases shall have the
25 meanings ascribed to them in this Section, except when the context clearly indicates
26 a different meaning:

28	(2)  "School" means the Jimmy D. Long, Sr. Louisiana School of for Math,
29 Science, and the Arts.

1 §1963. Jimmy D. Long, Sr. Louisiana School of for Math, Science, and the Arts;
2	creation; location; governance; relationship with educational boards
3	and state superintendent
4	A.(1) There is hereby created the Jimmy D. Long, Sr. Louisiana School of
5 for Math, Science, and the Arts which shall be a residential institution located on the
6 campus of Northwestern State University of Louisiana at Natchitoches. The school
7 shall open and formally begin operation with the fall semester of 1983. The school
8 shall be funded by the state from monies appropriated therefor; and, full-time
9 students at the school shall attend without payment of tuition.
10	(2) The official name of the school shall be the "Jimmy D. Long, Sr.
11 Louisiana School for Math, Science, and the Arts"; however, the school may
12 continue to use "Louisiana School of Math, Science, and the Arts" for all
13 practical purposes as determined by the board.

15 §1964. Board of directors; creation; membership; terms; powers, duties, and
16	functions; voting; compensation
17	A. There is hereby created a board of directors for the school, sometimes
18 hereinafter referred to as the "board". The board shall be composed of twenty-four
19 members as follows:

21	(15) The president of the Jimmy D. Long, Sr. Louisiana School of for Math,
22 Science, and the Arts Alumni Association or his designee.

24 §1968.1. Funding; inclusion in the minimum foundation program formula; other
25	appropriated state funds
26	A.(1) The board of directors of the Jimmy D. Long, Sr. Louisiana School for
27 Math, Science, and the Arts annually shall prepare and adopt a recommended
28 formula to adequately fund the educational programs at the school. The formula shall
29 have as its goal to provide state funding for the school which shall not be less than
30 the average funding on a per-student basis at peer institutions in other states having

1 similar programs and enrollments and may provide for achieving its goal over a
2 multiyear period. The recommended formula shall be submitted to the division of
3 administration as the total budget request for the school.

5	B.(1) For the purposes of this Section, the Jimmy D. Long, Sr. Louisiana
6 School for Math, Science, and the Arts shall be considered a public secondary school
7 and, as such, shall be included by the State Board of Elementary and Secondary
8 Education in the formula required by Article VIII, Section 13 of the Constitution of
9 Louisiana used to determine the cost of a minimum foundation program of education
10 in all public elementary and secondary schools.

12 §1970.1.  Legislative intent
13	It is the intent of the legislature to establish a college-based residential school
14 for certain high school students with the express purpose of providing a more
15 challenging educational experience and a more enriched creative environment for the
16 children of this state who have a demonstrated talent for and interest in pursuing the
17 creative and performing arts and of developing such children to their full potential. 
18 This school will serve only as a magnet school for the arts, and not as a magnet
19 school for mathematics nor the sciences.  There shall be no duplication of programs
20 already offered by the Jimmy D. Long, Sr. Louisiana School for Math, Science, and
21 the Arts in Natchitoches.  Beyond a demonstration of minimum competencies
22 expected of all equivalent high school students in Louisiana, admission criteria at the
23 Louis Armstrong High School for the Arts shall not be based upon competitive
24 academic testing, but exclusively upon auditions, or submission of creative writing
25 and art.

27 §1970.3.  Louis Armstrong High School for the Arts; creation; location; governance;
28	relationship with the University of Southwestern Louisiana at
29	Lafayette
30	A.  There is hereby created the Louis Armstrong High School for the Arts

1 which shall be a residential institution located on a satellite campus of the University
2 of Southwestern Louisiana at Lafayette at a location in Vermilion Parish. The
3 school may open and begin operation in the fall semester of 1999 only if all capital
4 construction needs for the first ten years have been met or funding for such
5 construction has been secured.  The school may be funded by the state from monies
6 appropriated for this purpose.  Full-time students at the school may have the same
7 state support, and pay the same fees and tuition, as the Jimmy D. Long, Sr.
8 Louisiana School for Math, Science, and the Arts in Natchitoches.

10 §1970.9.  Funding formula
11	A.  The school board of the Louis Armstrong High School for the Arts
12 annually shall prepare and adopt a recommended formula to adequately fund the
13 educational programs at the school.  The formula shall be identical to that adopted
14 by the Jimmy D. Long, Sr. Louisiana School for Math, Science, and the Arts in
15 Natchitoches.

17	E.  The amount of funding for any budget request submitted as provided in
18 this Section shall be determined by the legislature.  No appropriation made under the
19 provisions of this Section shall exceed on a per-student basis any amount
20 appropriated in the same fiscal year to the Jimmy D. Long, Sr. Louisiana School for
21 Math, Science, and the Arts in Natchitoches.
22 Section 3.  R.S. 36:651(Q) is hereby amended and reenacted to read as follows:
23 §651. Transfer of boards, commissions, departments, and agencies to Department of
24	Education; boards, commissions, and agencies within Department of
25	Education

27	Q. The Jimmy D. Long, Sr. Louisiana School of for Math, Science, and the
28 Arts and its board of directors (R.S. 17:1961 et seq.) is placed within the Department
29 of Education and shall exercise and perform its powers, duties, functions, and
30 responsibilities in the manner provided for agencies transferred in accordance with

1 the provisions of R.S. 36:801.1.

3 Section 4.  R.S. 39:98.3(C)(2) and 467(B)(2) are hereby amended and reenacted to
4 read as follows:
5 §98.3. Appropriations from the Health Excellence Fund, the Education Excellence
6	Fund, and the TOPS Fund

8	C. Appropriations from the Education Excellence Fund shall be restricted as
9 follows:
10	*          *          *
11	(2) Appropriations shall be made each year to the Louisiana School for the
12 Deaf, the Louisiana School for the Visually Impaired, the Louisiana Special
13 Education Center in Alexandria, the Jimmy D. Long, Sr. Louisiana School for
14 Math, Science, and the Arts, the New Orleans Center for Creative Arts and the Louis
15 Armstrong High School for the Arts, after such schools are operational, to provide
16 for a payment to each school of seventy-five thousand dollars plus an allocation for
17 each pupil equal to the average statewide per pupil amount provided each city,
18 parish, and local school system pursuant to Paragraphs (4) and (5) of this Subsection.

20 §467. Sales of services and tangible personal property at a publicly owned domed
21	stadium facility or baseball facility; sales and use tax; exemptions

23	B.	*          *          *
24	(2) Disposition of state tax proceeds. Of the monies remaining after
25 satisfaction of the requirements of Article VII, Section 9(B) of the Constitution of
26 Louisiana concerning the Bond Security and Redemption Fund, and R.S. 47:318(A)
27 concerning support of economic development, an amount equal to thirty percent of
28 the proceeds of the tax imposed under R.S. 47:321 on sales occurring for or at the
29 state-owned domed facility described in Subparagraph (A)(5)(a) of this Section shall
30 be allocated one-half to the Jimmy D. Long, Sr. Louisiana School of for Math,

1 Science, and the Arts, and one-half to the New Orleans Center for Creative Arts. All
2 monies remaining thereafter shall be deposited into the state general fund. For
3 purposes of this allocation, on the last day of November of each year the secretary
4 of the Department of Revenue shall provide to the chairman of the Joint Legislative
5 Committee on the Budget and the commissioner of administration an official
6 estimate of the amount of state revenues received within the previous twelve months
7 which were derived from the tax imposed pursuant to R.S. 47:321 from sales for or
8 at the state-owned domed facility described in Subparagraph (A)(5)(a) of this
9 Section. The estimate shall be utilized by the commissioner of administration in the
10 preparation of the following year's executive budget in which a recommendation
11 shall be made to appropriate such amounts as may be necessary to provide for this
12 allocation.

14 Section 5.  Nothing in this Act shall require the school to make changes to the
15 stationery, diplomas, transcripts, logo, insignia, licensed or branded merchandise,
16 promotional and fundraising items, or other related items or products, including class rings
17 and signage, all as determined by the board.
18 Section 6.  This Act shall become effective upon signature by the governor or, if not
19 signed by the governor, upon expiration of the time for bills to become law without signature
20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
21 vetoed by the governor and subsequently approved by the legislature, this Act shall become
22 effective on the day following such approval.
