Provides relative to bid procedures for contractors. (8/1/17) 1 AN ACT 2 To amend and reenact R.S. 37:2163(A)(1), relative to contractors; to provide for bid 3 specifications and requirements; to provide for certain conditions; and to provide for 4 related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 37:2163(A)(1) is hereby amended and reenacted to read as follows: 7 ยง2163. Bid procedures; penalty 8 A.(1) It is the intent of this Section that only contractors who hold an active 9 license be awarded contracts either by bid or through negotiation. All architects, 10 engineers, and awarding authorities shall place in their bid specifications the 11 requirement that a contractor shall certify that he holds an active license under the 12 provisions of this Chapter and show by showing his license number on the bid 13 envelope. In the case of an electronic bid proposal, a contractor may submit an 14 authentic digital signature on the electronic bid proposal accompanied by the 15 contractor's license number in order to meet the requirements of this Paragraph. 16 Except as otherwise provided herein, if the bid does not contain the contractor's 17 certification and show the contractor's license number on the bid envelope, the bid Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Present law requires that all architects, engineers, and awarding authorities place in their bid specifications the requirement that a contractor shall certify that he holds an active license and show his license number on the bid envelope. Proposed law provides that the bid specifications require that the contractor certify he holds an active license by showing his license number on the bid envelope. Present law provides that if the bid does not contain the contractor's certification and show the contractor's license number on the bid envelope, the bid shall be automatically rejected. Proposed law provides that if the bid does not contain the contractor's license number, the bid shall be automatically rejected. Effective August 1, 2017.
