PORTS/HARBORS/TERMINALS.  Provides relative to meetings, election of officers, and 
per diem for members of the Greater Baton Rouge Port Commission. (8/1/17)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 34:1221(A) and 1222, relative to
3 ports, harbors, and terminals; to provide relative to meetings, election of officers, and
4 per diem for members of the Greater Baton Rouge Port Commission; and to provide
5 for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The introductory paragraph of R.S. 34:1221(A) and 1222 are hereby
8 amended and reenacted to read as follows:
9 §1221. Creation of Greater Baton Rouge Port Commission; per diem; number of
10	days per diem allowed members
11	A. There is hereby created a commission to be known as the Greater Baton
12 Rouge Port Commission which shall be composed of fifteen members appointed by
13 the governor who shall serve at the pleasure of the governor. The members shall
14 receive per diem; provided, however, that the per diem of each member shall not
15 exceed seventy-five dollars per day during the time the member is in actual
16 attendance upon the board, or performing duties authorized by the board. The per
17 diem shall be payable for a maximum of twenty-four days per year, except if an

1 emergency is declared by the governor. During the period of an emergency as
2 determined by the governor, the commission shall be authorized to hold as many
3 meetings or emergency activities as the commission deems necessary and the
4 members shall be paid per diem for such meetings or activities. Members shall be
5 appointed as follows:

8	The commission shall elect from among its own members at its regularly
9 scheduled meeting each November, a president, a vice president, a secretary, and
10 a treasurer, whose respective duties shall be prescribed by the commission.  At the
11 option of the commission the offices of the secretary and treasurer may be held by
12 one person.  The commission shall meet in regular session as provided in R.S.
13 34:1221 sessions and shall also meet in special session sessions at the call of the
14 president of the commission, or on the written request of five members of the
15 commission.  A majority of the members of the commission shall constitute a
16 quorum and all action or resolutions of the commission must shall be approved by
17 the affirmative vote of not less than a majority of all members of the commission. 
18 The commission shall prescribe rules to govern its meetings and shall fix the place
19 at which meetings shall be held. The members shall receive per diem set by the
20 commission during the time the member is in actual attendance upon the board,
21 or performing duties authorized by the board. The per diem shall be payable
22 for a maximum of twenty-four days per year, except when an emergency is

Present law creates the Greater Baton Rouge Port Commission, composed of 15 members
appointed by the governor, and provides for per diem for each member not to exceed $75
per day during the time a member is in actual attendance upon the board, or performing
duties authorized by the board; provides for payment of per diem for a maximum of 24 days
per year, except when an emergency is declared by the governor; provides for an unlimited
number of emergency meetings or emergency activities as the commission deems necessary
and requires payment of per diem to members for such meetings or activities.
Present law requires commission members to elect the following officers from among its
members: president, vice president, secretary, and treasurer; provides an option for the
offices of secretary and treasurer to be held by one person; requires the commission to meet
in regular and special session at the call of the commission's president or upon written
request of five commission members; provides that a quorum is a majority of members of
the commission and that all action or resolutions of the commission shall be approved by
affirmative votes of not less than a majority of all members of the commission; provides for
the commission to prescribe rules to govern its meetings and to fix the place of its meetings.
Proposed law changes present law to require election of officers at the commission's
regularly scheduled meeting each November, and changes per diem from $75 to per diem
set by the commission.
