(7/1/18) 1 AN ACT 2 To amend and reenact R.S. 39:54(A)(1), relative to appropriations; to provide that 3 appropriations shall not exceed ninety-eight percent of the official forecast in effect 4 at the time the appropriations are made; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 39:54(A)(1) is hereby amended and reenacted to read as follows: 7 ยง54. Limitations on appropriations 8 A.(1) Appropriations by the legislature from the state general fund and 9 dedicated funds for any fiscal year shall not exceed ninety-eight percent of the 10 official forecast in effect at the time the appropriations are made, except in those 11 years when the official forecast of recurring revenues for the ensuing fiscal year 12 are at least one percent less than the official forecast for the current fiscal year. 13 Except as otherwise provided by R.S. 39:75(E), appropriations by the legislature 14 from any fund shall not exceed ninety-eight percent of the official forecast of 15 money available for appropriation from that fund in effect at the time the 16 appropriations are made. 17 * * * Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. DIGEST SB 229 Original 2017 Regular Session Tarver Present law limits appropriations by the legislature by providing that appropriations from the state general fund and dedicated funds for any fiscal year shall not exceed the official forecast in effect at the time the appropriations are made. Except as otherwise provided by R.S. 39:75(E), appropriations by the legislature from any fund shall not exceed the official forecast of money available for appropriation from that fund in effect at the time the appropriations are made. Proposed law revises present law by providing that beginning with the submission of agency budget requests for Fiscal Year 2018-2019, appropriations from the state general fund and dedicated funds for any fiscal year shall not exceed 98% of the official forecast in effect at the time the appropriations are made, except in those years when the official forecast of recurring revenues for the ensuing fiscal year are at least one percent less than the official forecast for the current fiscal year. Proposed law further provides that except as otherwise provided by R.S. 39:75(E), appropriations by the legislature from any fund shall not exceed 98% of the official forecast of money available for appropriation from that fund in effect at the time the appropriations are made.
