MOTOR VEHICLES. Provides with respect to for the "Animal Friendly" and "Krewe of

1 AN ACT
2 To amend and reenact R.S. 47:463.60(B) and to enact R.S. 47:463.192, relative to special
3 prestige license plates; to provide with respect to the "Animal Friendly" prestige
4 license plate; to provide for an increase of the annual royalty fee; to provide for the
5 creation, issuance, and design of the "Krewe of NYX" special prestige license plate;
6 to provide relative to the distribution of monies from the "Krewe of NYX" plates; to
7 provide for an effective date; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 47:463.60(B) is hereby amended and reenacted and R.S. 47:463.192
10 is hereby enacted to read as follows:
11 §463.60. Special prestige license plates; "Animal Friendly" prestige license plate;
12 animal population control; Pet Overpopulation Fund

14 B. The annual fee for this prestige license plate shall be a royalty fee of
15 twenty-five thirty-five dollars to be distributed as provided in this Section and a
16 handling fee of three dollars and fifty cents to be retained by the department to offset
17 a portion of administrative costs. These charges shall be in addition to the standard

1 motor vehicle license tax imposed by Article VII, Section 5 of the Constitution of
2 Louisiana.

4 §463.192. Special prestige license plates; "Krewe of NYX"
5 A. The secretary of the Department of Public Safety and Corrections
6 shall establish a special prestige motor vehicle license plate to be known as the
7 "Krewe of NYX" plate, provided there is a minimum of one thousand
8 applicants for such plates. The license plates shall be restricted to use on
9 passenger cars, pickup trucks, recreational vehicles, and vans.
10 B. The secretary shall work in conjunction with the captain of the Krewe
11 of NYX to select the color and design of the plate, provided it is in compliance
12 with R.S. 47:463(A)(3).
13 C. The special prestige license plate shall be issued, upon application, to
14 any member in good standing of the Krewe of NYX.
15 D. The department shall collect an annual royalty fee of twenty-five
16 dollars that shall be disbursed in accordance with Subsection E of this Section.
17 This fee shall be in addition to the standard motor vehicle license tax imposed
18 by Article VII, Section 5 of the Constitution of Louisiana, and a handling fee of
19 three dollars and fifty cents for each plate to be retained by the department to
20 offset a portion of administrative costs.
21 E. The annual royalty fee shall be collected by the department and
22 forwarded to the Krewe of NYX. The monies received from the royalty fees
23 shall be used solely for the activities of the Krewe of NYX.
24 F. The secretary shall adopt rules and regulations as are necessary to
25 implement the provisions of this Section.
26 Section 2. This Act shall become effective upon signature by the governor or, if not
27 signed by the governor, upon expiration of the time for bills to become law without signature
28 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
29 vetoed by the governor and subsequently approved by the legislature, this Act shall become

1 effective on the day following such approval.

Present law provides for special prestige license plates for automobiles, including the
"Animal Friendly" prestige license plate.
Present law provides for a $25 annual royalty fee and distributes the avails of the royalty fee
each quarter to the Pet Overpopulation Advisory Council.
Proposed law increases the annual royalty fee to $35.
Proposed law establishes a special prestige motor vehicle license plate to be known as the
"Krewe of NYX" plate, provided there is a minimum of 1,000 applicants for such plates.
Proposed law provides that the special prestige license plate will be issued, upon application,
to any member in good standing of the Krewe of NYX.
Proposed law creates annual royalty fee to provide for the creation, issuance, and design of
the "Krewe of NYX" special prestige license plate, and provides relative to the distribution
of monies collected from the "Krewe of NYX" plates.
Effective upon signature of the governor or lapse of time for gubernatorial action.
