1	AN ACT
2 To amend and reenact R.S. 56:322.2(D), relative to shad gill nets; to provide for the
3 commercial harvest of shad and skipjack; to provide for the seasons for taking of
4 shad and skipjack; to provide limitations for the taking of shad as bait; to provide
5 terms and requirements; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 56:322.2(D) is hereby amended and reenacted to read as follows:
8 ยง322.2. Shad gill nets; commercial harvest of shad and skipjack herring

10	D.(1) The closed season for commercially harvesting shad and skipjack as
11 provided for in this Section shall include the months of July, August, September, and
12 October of each year. Shad and skipjack may be taken after sunset and before sunrise
13 during open season. However, there shall be no commercial taking of shad or
14 skipjack on any Saturday or Sunday.
15	(2) During the open season, there shall be no daily take or possession limit
16 for the commercial harvest of shad and skipjack by properly licensed shad gill net
17 commercial fishermen.  Shad and skipjack may be taken after sunset and before

1 sunrise during open season. However, there shall be no commercial taking of
2 shad or skipjack on any Saturday or Sunday.
3	(3) During the closed season and any Saturday or Sunday during open
4 season, shad may be taken with a shad gill net for bait purposes only and with
5 the following limitations:
6	(a) The shad gill net shall not exceed one hundred fifty feet in length.
7	(b) No more than fifty pounds of shad shall be taken per day.
8	(c) The gill net shall be attended at all times.

10 Section 2.  This Act shall become effective upon signature by the governor or, if not
11 signed by the governor, upon expiration of the time for bills to become law without signature
12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
13 vetoed by the governor and subsequently approved by the legislature, this Act shall become
14 effective on the day following such approval.

Present law prohibits the taking of shad and skipjack during the closed season and on
weekends of the open season.
Proposed law allows the taking of shad during the closed season and on weekends of the
open season with a shad gill net for bait purposes only and with the following limitations:
(1)The shad gill net shall not exceed 150 feet in length.
(2)No more than 50 pounds of shad shall be taken per day.
(3)The gill net shall be attended at all times.
Effective upon signature of the governor or lapse of time for gubernatorial action.
