SENATE RESOLUTION NO. 147

PUBLIC MEETINGS. Requests that legislation allowing school boards and local governing
authorities be authorized to go into executive session when discussing economic
development projects be included in the call for any special legislative session in 2017.
1 A RESOLUTION
2 To urge and request that legislation allowing school boards and local governing authorities
3 be authorized to go into executive session when discussing economic development
4 projects be included in the call for any special legislative session in 2017.
5 WHEREAS, current law provides that a public body may hold executive sessions
6 upon an affirmative vote, taken at an open meeting for which notice has been given pursuant
7 to R.S. 42:19, of two-thirds of its constituent members present; and
8 WHEREAS, an executive session shall be limited to matters allowed to be exempted
9 from discussion at open meetings by R.S. 42:17; however, no final or binding action shall
10 be taken during an executive session; and
11 WHEREAS, the vote of each member on the question of holding such an executive
12 session and the reason for holding such an executive session shall be recorded and entered
13 into the minutes of the meeting; and
14 WHEREAS, nothing in current law shall be construed to require that any meeting be
15 closed to the public; and
16 WHEREAS, exceptions that allow for executive sessions described in R.S. 42:17 are
17 authorized by law; and
18 WHEREAS, the undertaking of an economic development project may require school

1 boards and local governing authorities to hold executive sessions to discuss pertinent matters
2 related to the projects; and
3 WHEREAS, it is essential that school boards and local governing authorities are
4 permitted to hold executive sessions for discussion of economic development projects; and
5 WHEREAS, it is appropriate to request that legislation allowing school boards and
6 local governing authorities be authorized to go into executive session to discuss economic
7 development projects be included into the call for any special legislative session that may
8 be called in 2017.
9 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana
10 does hereby request that legislation allowing school boards and local governing authorities
11 be authorized to go into executive session when discussing economic development projects
12 be included in the call for any special legislative session in 2017.
