HLS 183ES-6 ORIGINAL 2018 Third Extraordinary Session HOUSE BILL NO. 1 BY REPRESENTATIVE HENRY APPROPRIATIONS/GENERAL: Makes supplemental appropriations for Fiscal Year 2018-2019 (Item #3) 1 AN ACT 2To appropriate funds and to make certain reductions in appropriations from certain sources 3 to be allocated to designated agencies and purposes in specific amounts for the 4 making of supplemental appropriations and reductions for said agencies and 5 purposes for Fiscal Year 2018-2019; to provide for effectiveness; to provide for an 6 effective date; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. Section 19.A of Act No. 2 of the 2018 Second Extraordinary of the 9Legislature is hereby amended and reenacted to read as follows: 10 * * * 11 Section 19.A. Appropriations contained in this Section of this Act shall 12 become effective upon the enactment of action taken to raise revenues in the 2018 13 Second and Third Extraordinary Session Sessions of the Legislature, and 14 incorporated into the Fiscal Year 2018-2019 official forecast of the Revenue 15 Estimating Conference. To the extent that additional revenues are incorporated into 16 the official forecast, the additional revenues shall be used first to fund the following 17 items in the following order of priority: first, the supplemental appropriation to 18 Higher Education, Board of Regents in the amount of $88,368,592 of State General 19 Fund (Direct) for TOPS, then the supplemental appropriation to Higher Education, 20 Board of Regents for Go Grants, then the supplemental appropriation to Higher Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 183ES-6 ORIGINAL HB NO. 1 1 Education, Board of Regents in the amount of $70,379,221of State General Fund 2 (Direct) for the restoration of operating expenses, then the supplemental 3 appropriation to the Department of Education, Nonpublic Educational Assistance to 4 the Required Services Program in the amount of $7,589,213 of State General Fund 5 (Direct), then the supplemental appropriation to the Department of Education, 6 Nonpublic Educational Assistance to the School Lunch Salary Supplement Program 7 in the amount of $7,002,614 of State General Fund (Direct), then the supplemental 8 appropriation to the District Attorney and Assistant District Attorneys Program in 9 the amount of $25,809,713 of State General Fund (Direct), and then the 10 supplemental appropriation to the Constables and Justices of the Peace Supplemental 11 Payments Program in the amount of $980,000 of State General Fund (Direct). To the 12 extent sufficient revenues are not enacted in the 2018 Second and Third 13 Extraordinary Session Sessions of the Legislature to fully fund each appropriation 14 contained herein, the revenues recognized shall be used to fully fund the prioritized 15 items listed above and then distributed to the remaining appropriations contained in 16 this Section on a pro rata basis. 17 * * * 18 Section 2. This Act shall become effective on July 1, 2018; if vetoed by the governor 19and subsequently approved by the legislature, this Act shall become effective on July 1, 202018, or on the day following such approval by the legislature, whichever is later. Proposed law requires certain appropriations to receive priority funding if funding is insufficient to fully fund appropriations in the following order: TOPS, Go Grants, higher education, nonpublic education assistance, DA's & Assistant DA's, and supplemental pay for constables and justices of the peace. Requires the remaining appropriations to be reduced on a pro rata basis if funding is insufficient to fully fund appropriations. Effective July 1, 2018.
