HOUSE BILL NO. 104

ENERGY/PIPELINES:  Increases the ceiling on penalties for pipeline safety violations
1	AN ACT
2To amend and reenact R.S. 30:544(A)(1), relative to pipeline safety violations; to raise the
3 maximum penalty for such violations; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 30:544(A)(1) is hereby amended and reenacted to read as follows:
6 ยง544.  Violation; penalties, civil and criminal
7	A.(1)  Any person who shall be determined by the assistant secretary, after
8 notice and an opportunity for a hearing, to have violated any provision of this
9 Chapter or any rule, regulation, or order promulgated or issued under this Chapter
10 shall be liable to the office of conservation for a civil penalty not to exceed ten two
11 hundred thousand dollars for each violation for each day that the violation persists,
12 except that the maximum civil penalty shall not exceed five hundred thousand two
13 million dollars for any related series of violations.

Abstract: Increases the maximum allowable penalty for pipeline safety violations.
Present law authorizes the commissioner of conservation to levy certain penalties for
violations of the pipeline safety provisions of law.  Requires a notice of the violation and an

opportunity for a hearing.  Authorizes the imposition of a penalty not to exceed $10,000 per
day for each violation with a maximum penalty not to exceed $500,000 for any related series
of violations.
Proposed law increases the maximums to $200,000 per day of violation and a maximum of
$2 million for any related series of violations.
