HOUSE BILL NO. 116

COASTAL COMMISSION:  Authorizes and directs the Coastal Protection and Restoration
Authority to promulgate rules and guidelines for their contracting authorities
1	AN ACT
2To amend and reenact R.S. 49:214.6.2(A), relative to the Coastal Protection and Restoration
3 Authority; to authorize and direct the Coastal Protection and Restoration Authority
4 to issue rules, regulations, or guidelines for the implementation of their existing
5 contracting authority; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 49:214.6.2(A) is hereby amended and reenacted to read as follows: 
8 ยง214.6.2.  Functions and responsibilities; coastal activities
9	A.  The authority shall administer the programs of the Coastal Protection and
10 Restoration Authority Board.  The executive director may use his contracting
11 authority, or the contracting authority of any state department or agency, to
12 implement the provisions of this Chapter.  Such contracting authority shall include
13 construction management at risk, operation and maintenance, design-build, design-
14 build-operate and maintain, design-build-finance-operate and maintain, outcome-
15 based performance contracts, or any combination of design, construction, finance,
16 and services for operation and maintenance of an integrated coastal protection
17 project, where appropriate.  The Coastal Protection and Restoration Authority is
18 hereby authorized and directed to promulgate, through the Administrative Procedure
19 Act, rules, regulations, or guidelines for the implementation of the contracting
20 authority granted by the provisions of this Section.  The Coastal Protection and

1 Restoration Authority shall have the authority to execute and implement contracts
2 entered into by the board.

Abstract:  Authorizes and directs the Coastal Protection and Restoration Authority to issue
rules, regulations, or guidelines for the implementation of their existing contracting
authority.
Present law authorizes the executive director of the Coastal Protection and Restoration
Authority (CPRA) to use his contracting authority, or the contracting authority of any state
department or agency, for the operation and maintenance of an integrated coastal protection
project.  Specifies that the contracting authority includes construction management at risk,
operation and maintenance, design-build, design-build-operate and maintain, design-build-
finance-operate and maintain, outcome-based performance contracts, or any combination of
design, construction, finance, and services.
Proposed law authorizes and directs the CPRA to promulgate, through the Administrative
Procedure Act, rules, regulations, or guidelines for the implementation of the contracting
authority.
