HOUSE BILL NO. 116

COASTAL COMMISSION:  Authorizes and directs the Coastal Protection and Restoration
Authority to promulgate rules and guidelines for their contracting authorities
1	AN ACT
2To amend and reenact R.S. 49:214.6.2(A) and to enact R.S. 49:191(11)(a), relative to the
3 Coastal Protection and Restoration Authority; to authorize and direct the Coastal
4 Protection and Restoration Authority to issue rules, regulations, or guidelines for the
5 implementation of their existing contracting authority; and to provide for related
6 matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 49:214.6.2(A) is hereby amended and reenacted and R.S.
949:191(11)(a) is hereby enacted to read as follows: 
10	§191.  Termination of legislative authority for existence of statutory entities;
11 phase-out period for statutory entities; table of dates
12	Notwithstanding any termination dates set by any previous Act of the
13 legislature, the statutory entities set forth in this Section shall begin to terminate their
14 operations on July first of each of the following years, and all legislative authority
15 for the existence of any statutory entity, as defined in R.S. 49:190, shall cease as of
16 July first of the following year, which shall be the termination date:

1	(a)  The Coastal Protection and Restoration Authority and the Coastal
2 Restoration and Protection Authority Board to be reviewed by and re-creation to be
3 considered by the House Committee on Natural Resources and Environment and the
4 Senate Committee on Natural Resources.  Thereafter, the Coastal Protection and
5 Restoration Authority and the Coastal Restoration and Protection Authority Board
6 shall be reviewed and re-created every six years to coincide with the review and
7 adopted of the comprehensive master plan for integrated coastal restoration.

9 §214.6.2.  Functions and responsibilities; coastal activities
10	A.  The authority shall administer the programs of the Coastal Protection and
11 Restoration Authority Board.  The executive director may use his contracting
12 authority, or the contracting authority of any state department or agency, to
13 implement the provisions of this Chapter.  Such His contracting authority shall
14 include construction management at risk, operation and maintenance, design-build,
15 design-build-operate and maintain, design-build-finance-operate and maintain,
16 outcome-based performance contracts, or any combination of design, construction,
17 finance, and services for operation and maintenance of an integrated coastal
18 protection project, where appropriate.  The Coastal Protection and Restoration
19 Authority shall promulgate, through the Administrative Procedure Act, rules,
20 regulations, or guidelines for the implementation of the contracting authority granted
21 by the provisions of this Section.  The Coastal Protection and Restoration Authority
22 shall have the authority to execute and implement contracts entered into by the
23 board.

Abstract:  Authorizes and directs the Coastal Protection and Restoration Authority to issue
rules, regulations, or guidelines for the implementation of their existing contracting
authority and provides for sunset review of the Coastal Protection and Restoration
Authority.
Present law authorizes the executive director of the Coastal Protection and Restoration
Authority (CPRA) to use his contracting authority, or the contracting authority of any state
department or agency, for the operation and maintenance of an integrated coastal protection
project.  Specifies that the contracting authority includes construction management at risk,
operation and maintenance, design-build, design-build-operate and maintain, design-build-
finance-operate and maintain, outcome-based performance contracts, or any combination of
design, construction, finance, and services.
Proposed law requires the CPRA to promulgate, through the Administrative Procedure Act,
rules, regulations, or guidelines for the implementation of the contracting authority.
Proposed law requires sunset review of the CPRA and the CPRA Board for July 1, 2023.
Further provides for a sunset review every six years thereafter to coincide with the review
and adoption of the comprehensive master plan for coastal restoration.
