Existing law generally requires suspension of retirement benefits for a retiree of the Teachers'
Retirement System of La. who returns to work in a position covered by the system.  Provides
exceptions.
Existing law provides that a retiree may return to work in specified positions without
reduction of benefits if there is a critical shortage of properly certified candidates to fill a
vacancy in such a position.  Provides procedures for establishing that a critical shortage
exists.  The positions to which existing law is applicable are: classroom teacher in grades
kindergarten through 12th, speech therapist, speech pathologist, audiologist, educational
diagnostician, school social worker, school counselor, and school psychologist.  New law
adds pre-kindergarten teacher to the list of positions to which a certified retiree may return
to work without reduction of benefits if a critical shortage exists.
Existing law authorizes a retiree to return to work as a substitute classroom teacher, an
adjunct professor, an instructor in an adult literacy program, or a school nurse and to
continue to receive his benefit; however, the allowable employment earnings of such retiree
are capped at 25% of his benefit amount; requires a reduction in the retirement benefit if the
cap is exceeded.  New law adds presenter of professional development and tutor to the list
of positions to which a retiree may return subject to the earnings limitation.
Effective July 1, 2018.
