HOUSE BILL NO. 152

GAMING:  Provides with respect to the exclusion or ejection of certain persons from
gaming establishments
1	AN ACT
2To amend and reenact R.S. 27:27.2(A) and 27.4(A), relative to gaming; to provide for the
3 exclusion or ejection of certain persons from gaming establishments; to prohibit the
4 exclusion or ejection of persons based upon certain factors; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 27:27.2(A) and 27.4(A) are hereby amended and reenacted to read
8as follows: 
9 §27.2.  Board designated excluded persons
10	A.  The board shall adopt rules to provide for the establishment of a list of
11 persons who are to be excluded from any room, premises, or designated gaming area
12 of any establishment where gaming is conducted pursuant to a license or contract
13 issued pursuant to the provisions of this Title.  The rules must shall define the
14 standards for exclusion and include standards relating to the following persons:
15	(1)  Those who are career or professional offenders as defined by the rules
16 of the board.
17	(2)  Those who have been convicted of a criminal offense as specified by the
18 board.
19	(3)(a)  Those whose presence in a gaming establishment operated by a
20 licensee or the casino operator would be adverse to the interests of Louisiana or

1 gaming operations.  For purposes of this Paragraph, the following persons may be
2 excluded:
3	(i)  Persons suspected of cheating.
4	(ii) Persons whose gaming privileges, permits, or licenses have been
5 suspended, revoked, or denied.
6	(iii) Persons who pose a threat to the safety of the patrons or employees of
7 the casino operator or casino manager or any casino gaming licensee.
8	(iv)  Persons with a documented history of conduct involving the disruption
9 of the gaming operations in any jurisdiction.
10	(v)  Persons subject to an order of a Louisiana court excluding such persons
11 from any gaming establishment.
12	(vi)  Persons with pending charges for a gaming or gambling crime or a crime
13 related to the integrity of gaming operations.
14	(b)  A person may not be excluded from a gaming establishment operated by
15 a licensee or the casino operator for reasons based solely on the skill level of the
16 person.

18 §27.4.  Exclusion or ejection of persons
19	A.  Any licensee, permittee, or the casino gaming operator may exclude or
20 eject any person for any reason if such person engages in unlawful or disruptive
21 conduct. , except No licensee, permittee, or the casino gaming operator may exclude
22 or eject any person based upon race, color, creed, national origin, sex, or disability
23 as defined in R.S. 51:2232(11).

Abstract:  Provides certain reasons for which a gaming establishment may exclude or eject
a person, and prohibits the exclusion or ejection of a person based solely on the skill
of the person. 
Present law requires the Gaming Control Board to establish a list of persons to be excluded
from gaming establishments for the following reasons:
(1)Career or professional offenders as defined by rules of the board.
(2)Persons convicted of a criminal offense as specified by the board.
(3)Persons whose presence would be adverse to the interests of Louisiana or
gaming operations.
Proposed law retains present law and lists the following persons who may be excluded
pursuant to present administrative rules promulgated by the board:
(1)Persons suspected of cheating.
(2) Persons whose gaming privileges, permits, or licenses have been suspended,
revoked, or denied.
(3)Persons who pose a threat to the safety of the patrons or employees of the
casino operator or casino manager or any casino gaming licensee.
(4)Persons with a documented history of conduct involving the disruption of the
gaming operations in any jurisdiction.
(5)  Persons subject to an order of a Louisiana court excluding such persons from
any gaming establishment.
(6)Persons with pending charges for a gaming or gambling crime or a crime
related to the integrity of gaming operations.
Proposed law further adds that a person may not be excluded from a gaming establishment
for reasons based solely on the skill level of the person. 
Present law provides that gaming operators, licensees, or permittees may exclude or eject
any person for any reason, except on the basis of race, color, creed, national origin, sex, or
disability. 
Proposed law removes the authority to exclude or eject persons for any reason and provides
that gaming operators, licensees, or permittees may exclude or eject persons who engage in
unlawful or disruptive conduct.  Proposed law retains the present law provisions prohibiting
the exclusion of persons based upon race, color, creed, national origin, sex, or disability.
