BILL NO. 2 BY REPRESENTATIVE ABRAMSON CAPITAL OUTLAY: Provides for the comprehensive Capital Outlay budget 1 AN ACT 2To provide with respect to the capital outlay budget and the capital outlay program for state 3 government, state institutions, and other public entities; to provide for the designation 4 of projects and improvements; to provide for the financing thereof making 5 appropriations from certain sources; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. The following sums or so much thereof as may be necessary are hereby 8appropriated out of any monies in the state treasury from the sources specified, from federal 9funds and self-generated revenues belonging to the state of Louisiana and/or collected by 10boards, commissions, departments, and agencies thereof, all for making capital outlay and 11for the purposes and in the amounts specified herein for the Fiscal Year commencing July 121, 2018, and ending June 30, 2019, subject to the conditions thereafter provided: 13 A project with funding payable from General Obligation Bonds Priority 1 indicates that 14the funding for the project includes the reauthorization of funding which was previously 15granted as a line of credit by the State Bond Commission in Fiscal Year 2017-2018. As used 16in this Section, the term "general obligation bonds" means state general obligation bonds or 17other evidences of indebtedness payable from the Bond Security and Redemption Fund. The 18amount set forth in this Section opposite each project, or so much thereof as may be 19necessary, is hereby appropriated and payable from the source of funding indicated; 20provided, however, amounts appropriated and payable from federal funds may be 21encumbered or expended only to the extent such amounts shall have been committed or Page 1 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1received. Pursuant to the provisions of R.S. 39:82, funds for planning, acquisition, 2construction, and major repair projects appropriated by this Act may be retained until 3completion of the project, even if no bona fide liability exists on the last day of the fiscal 4year. 5 This Act shall constitute the comprehensive state capital outlay budget for the 2018-2019 6Fiscal Year. Projects set forth which are payable from the proceeds available from the sale 7of general obligation bonds shall have the priorities as indicated. The Request for Line of 8Credit form used by the attorney general and Bond Counsel in evaluating Louisiana 9Constitutional, Internal Revenue Code, and applicable income tax regulations shall be filed 10with the commissioner of administration, State Bond Commission, and state attorney 11general. No general obligation bonds shall be sold, nor cash lines of credit granted to fund 12any lower priority project prior to the sale of general obligation bonds or the granting of cash 13lines of credit to fund all higher priority projects (the "general rule"), except as hereinafter 14provided. This prohibition against funding a lower priority project shall not apply upon a 15showing of an impossibility or impracticality either to proceed with all unfunded higher 16priority projects or to proceed with the funding of such projects or any part thereof through 17the issuance of general obligation bonds for any reason. Such showing shall be stated in 18reasonable detail in a certificate or certificates signed by the state agency responsible for 19administering the funding, and filed with the commissioner of administration and the State 20Bond Commission (hereinafter referred to as "the Commission"). Upon a determination by 21the Commission that proceeding with such a project or the funding thereof through the 22issuance of general obligation bonds is impractical or impossible, the Commission may then 23proceed with the sale of general obligation bonds or the granting of cash lines of credit 24without regard to the priority of the unfunded projects determined to be impossible or 25impractical. 26 Upon recommendation by the state agency responsible for administering the funding, if 27it is determined at any time that proceeding with the project or with the funding thereof is 28no longer impossible or impractical, the State Bond Commission may rescind the certificate 29of impossibility or impracticality and may proceed with the project or with the issuance of 30general obligation bonds or the granting of cash lines of credit to fund the project. Page 2 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Alternatively, the Interim Emergency Board (hereinafter referred to as "the Board"), upon 2reviewing certificates as described above and determining that proceeding with such project 3or the funding thereof through the issuance of general obligation bonds is impossible or 4impractical, may designate a lower priority for such project. The Board's determination and 5lower priority designation shall be submitted to the members of the legislature for their 6approval in accordance with the provisions of Chapter 3-B of Subtitle I of Title 39 of the 7Louisiana Revised Statutes of 1950. In accordance with the provisions of Chapter 3-B of 8Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, whenever at the written 9request of the appropriate legislators and agency, the Board determines that an adjustment 10to a project description originally set forth in such capital budget adopted by the legislature 11for a current fiscal year is necessary to correct a mistake in a project description, clarify a 12description, change the scope of a description, or make any other adjustment the Board 13deems necessary to implement the purpose of the project, such adjustment shall become 14effective only upon the approval by majority vote of the elected members of each house of 15the legislature in the manner provided for in Chapter 3-B of Subtitle I of Title 39 of the 16Louisiana Revised Statutes of 1950. 17 If such approval is granted, notification by the chair or secretary of the Board of the 18results of the balloting shall be transmitted to the State Bond Commission, which may then 19proceed with the sale of general obligation bonds or the granting of cash lines of credit for 20each change approved upon request of the commissioner of administration in accordance 21with the general rule. 22 With respect to Priorities 1 through 5, a lower priority project may be moved to a higher 23priority only upon a showing of an emergency or other cause not reasonably anticipated by 24the legislature, which shall be stated in reasonable detail in a certificate signed by the head 25of the appropriate department, political subdivision, or agency and filed with the 26commissioner of administration and the Board. Upon a determination by the Board that such 27project should be moved to a higher priority because of an emergency or other cause not 28reasonably anticipated by the legislature, the Board shall designate a higher priority to the 29project. The matter then shall be submitted to and be subject to the same approval by the 30members of the legislature in the manner previously indicated in this Section. If such Page 3 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1approval is granted, notification by the chair or secretary of the board of the change of 2priority shall be transmitted to the State Bond Commission, which then upon request of the 3commissioner of administration, may proceed with the sale of general obligation bonds or 4the granting of cash lines of credit in accordance with the general rule. As to projects within 5a priority, the State Bond Commission acting on requests submitted by the commissioner of 6administration shall determine when such project, or phases thereof, shall be funded. In 7making such determination, the State Bond Commission shall consider the amount of 8proceeds of general obligation bonds to be made available in light of money and capital 9market conditions; the expenditure requirements of the project; the time required for 10architectural plans and drawings, public bidding, and site acquisition and preparation; 11availability of receipt of federal monies; litigation affecting the undertaking or completion 12of a project; federal tax laws and regulations regarding the sale of municipal bonds; and 13other items of a similar nature bearing upon the possibility or the necessity to commence a 14project or any particular phase thereof. 15 Any other provision of this Act to the contrary notwithstanding, projects described in 16Priority 5 of this Act shall not be moved to a higher priority except upon one of the 17following conditions: (1) Funding is necessary to complete or additionally fund a project 18located elsewhere in the Capital Outlay Act. Determination of such condition shall be made 19by the head of the appropriate department or agency by means of a certificate to that effect 20filed with the Interim Emergency Board, who shall, by mail ballot, request approval of such 21change and if approved by a majority of each house of the legislature it shall be funded, or 22(2) unless required by an emergency or other cause not reasonably anticipated by the 23legislature, to be in accordance with procedures set forth in this Section. However, the State 24Bond Commission may authorize a non-cash line of credit for any project in Priority 5 which 25represents that portion of construction contracts which were let during a previous fiscal year, 26or construction contracts which will be let during the current fiscal year, but which will not 27require cash expenditures during the year. Such non-cash lines of credit, when combined 28with previously sold bonds or with higher priority bonds or lines of credit, or with funds 29appropriated from other sources, will provide sufficient appropriated funds to award Page 4 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1equipment or construction contracts. Contracts shall not be awarded without approval of the 2division of administration. 3 Upon approval by the State Bond Commission, and subject to compliance with its 4policies and procedures and the procedures set forth herein, a line of credit providing for the 5use of funds in anticipation of the sale of general obligation bonds may be granted to the 6appropriate administering agency or department from the Comprehensive Capital Outlay 7Escrow Account, or if there is not a sufficient amount available in such account, from other 8available state cash in the state treasury, for capital improvement projects for which bond 9proceeds are appropriated by a current capital budget, prior to the actual issuance of bonds 10for such projects, unless the attorney general advises that an impediment exists to the valid 11issuance of the bonds on the date such line of credit is granted. 12 All bonds that are to be repaid, in whole or in part, by revenues generated by the project 13shall be designated as "Reimbursement Bonds". The State Bond Commission shall enter 14into such agreements as are necessary to provide that the agency or subdivision, whose 15project is reimbursable, shall pay the bond debt costs into the Bond Security and Redemption 16Fund. Such costs may be paid annually or at the end of the term of the bonds issued as 17determined by the State Bond Commission. 18 Priority 1 general obligation bond funding shall be limited to: 19 (1) Projects and amounts which were previously authorized by Act 4 of the 2017 Second 20Extraordinary Session of the Legislature; and which were granted cash lines of credit by the 21State Bond Commission. The bonds to fund these projects were not sold in Fiscal Year 222017-2018. 23 (2) The reauthorization of the portion of the outstanding Fiscal Year 2017-2018 Priority 245 Non-Cash Lines of Credit for projects which will require cash expenditures in Fiscal Year 252018-2019 and therefore must be converted to Cash Lines of Credit in Fiscal Year 2018- 262019. 27 (3) Commitments made in the Higher Education Desegregation Settlement Agreement. 28 Priority 2 general obligation bond projects are for the completion of plans and 29specifications, land acquisition, site preparation, or for construction which will begin during Page 5 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1the fiscal year. It is presently anticipated that the listed projects will require the sale of 2bonds or extension of lines of credit during the fiscal year after adoption of this Act. 3 Priority 3 general obligation bond projects are for the preparation of plans and 4specifications, land acquisition, site preparation, or for construction and shall be limited to 5funding for the portion of construction contracts which will not require cash expenditures 6during the fiscal year. The projects in this category shall be considered future year projects 7in the state's five-year capital outlay plan. It is presently anticipated that the listed projects 8will not require the sale of bonds or extension of lines of credit during the fiscal year. 9 Priority 4 general obligation bond projects are for the preparation of plans and 10specifications, land acquisition, site preparation, or for construction and shall be limited to 11funding for the portion of construction contracts which will not require cash expenditures 12during the fiscal year. The projects in this category shall be considered future year projects 13in the state's five-year capital outlay plan. It is presently anticipated that the listed projects 14will not require the sale of bonds or extension of lines of credit during the fiscal year. 15 Priority 5 general obligation bond funding shall be limited to funding for the portion of 16construction contracts which will not require cash expenditures during the fiscal year. These 17funds, when combined with previously sold bonds or with higher priority bonds on lines of 18credit, or with funds appropriated from other sources, will provide sufficient appropriated 19funds to award contracts. Non-cash lines of credit shall be required prior to the award of 20these contracts. 21 In accordance with the cash management plan adopted pursuant to R.S. 48:251(D) and 22the provisions of Act 161 of the 1998 First Extraordinary Session, the Department of 23Transportation and Development is authorized to enter into contracts or agreements for 24projects approved pursuant to the Highway Priority Program, Airport Construction and 25Development Priority Program, Port Construction and Development Priority Program, and 26Statewide Flood Control Program for projects bid and awarded, authorized, or commenced 27during the fiscal year which do not require cash expenditures for the full contract or 28agreement amount. The expenditure of funds appropriated in this Act, except appropriations 14made to nonprofit economic development corporations, shall be in conformity to all existing 15statutes relative to public bidding, contractual review, and R.S. 39:101 through 128 and any 16other statutes affecting the capital outlay program for state government, state institutions, 17and political entities. No contract shall be awarded for any project prior to the granting of 18a line of credit or the sale of bonds by the State Bond Commission, determination by the 19state treasurer that cash funding is available in the Comprehensive Capital Outlay Escrow 20Account for the project, or delivery of revenue bonds whose issuance is authorized in 21Section 1 of this Act. 22 Section 3. Payment for projects specified in this Act must be made by warrant 23submitted to the division of administration, Department of Transportation and Development, 24the state treasurer or other administering agency as provided in Section 8, whichever is 25appropriate, only to the extent of funds required for immediate payment. Copies of invoices 26or other supporting documentation shall be submitted with warrants. In the event that any 27equipment included in this Act, is procured pursuant to the provisions of the State Lease- 28Purchase Act, R.S. 39:1761 et seq., the amounts included in this Act for each such piece of 29equipment shall not be appropriated. The provisions of R.S. 39:1771 which require 30equipment to be leased under the State Lease-Purchase Act to be included in the executive 31budget and approved by the legislature through inclusion in the General Appropriation Act 32shall be considered waived upon the inclusion of such equipment in this Act. Projects 33contained in this Act may, at the direction of the division of administration and with the 34approval of the State Bond Commission, alternatively be funded through financing programs Page 65 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1heretofore or hereafter provided by a public trust and public corporation duly organized 2pursuant to R.S. 9:2341 et seq., having for its beneficiary the state and the Louisiana Local 3Government Environmental Facilities and Community Development Authority, pursuant to 4R.S. 33:4548.1 et seq. 5 Section 4. If at any time during the Fiscal Year 2018-2019, the governor should find, 6or the Joint Legislative Committee on the Budget or the commissioner of administration 7should report to the governor, that the receipts of the treasury are falling short or appear 8likely to fall short of the revenue estimates for the fiscal year and that a cash deficit is likely 9to be incurred, the governor shall take such steps as deemed necessary to prevent the 10occurrence of a cash deficit. In the event that a capital outlay project funded in this Act falls 11under an agency which is abolished or for which funds are not appropriated in the 2018-2019 12General Appropriation Act, then the funds appropriated in this Act for such capital outlay 13projects shall not be expended unless deemed necessary by the governor to protect life or 14property. In the event that legislation is enacted which transfers facilities or programs for 15which projects are funded in this Act, on behalf of one agency, institution, department, or 16management board to another agency, institution, department, or management board, then 17the projects in this Act shall be deemed transferred also. 18 Section 5. All monies appropriated by this Act and any applicable funds of a prior 19capital outlay budget act adopted by the legislature shall be deposited by the state treasurer 20in the Comprehensive Capital Outlay Escrow Account, established by this Section, in the 21state treasury. In accordance with R.S. 36:764, no later than sixty days following the end 22of each quarter, the state treasurer shall report to the Joint Legislative Committee on the 23Budget and the commissioner of administration, all funds contained in the Miscellaneous 24Fund of the Comprehensive Capital Outlay Escrow Account. Notwithstanding any 25provisions contained herein or other law to the contrary, any original issue premium or 26accrued interest proceeds received pursuant to the sale of general obligation bonds shall 27remain on deposit to the credit of the Bond Security and Redemption Fund until such time 28as they may be utilized in accordance with U.S. Department of the Treasury Regulations 29promulgated pursuant to the Internal Revenue Code of 1986. All such monies shall be 30administered according to the particular act pertaining to the fiscal year in which such Page 66 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1monies were appropriated. If it is determined by the director of the office of facility 2planning and control, division of administration, that the funds appropriated by this Act or 3any prior capital outlay budget act are not sufficient to complete the projects contained in 4any capital outlay budget act, through unavoidable deficiencies in appropriation, including 5administrative and legal requirements, the commissioner of administration, subject to 6approval of the Joint Legislative Committee on the Budget, may direct the use of interest 7earned from the investment of general obligation bond or note proceeds in the 8Comprehensive Capital Outlay Escrow Account, not to exceed an aggregate of five million 9dollars in any one fiscal year, for the purpose of completing the projects contained in any 10capital outlay budget act and such money shall be deemed appropriated in specific amounts 11necessary for such purpose. All appropriations in this Act which are made as additions to 12funds for previously authorized projects shall be included, for accounting purposes, in the 13account of the previously authorized projects. If it is determined by the director of the office 14of facility planning and control, division of administration, that it is cost effective and 15practical to combine individual appropriations, the commissioner of administration, subject 16to the approval of the Joint Legislative Committee on the Budget, may direct that two or 17more appropriations or parts thereof may be combined into a single project for accounting 18and audit purposes. The commissioner of administration may direct that funding in the 19various statewide and/or multiple parish projects for improvements for state facilities may 20be transferred to any project, in this Act or any previous Capital Outlay Act, which require 21supplemental funding for improvements for state facilities which qualify for funding through 22the various statewide and/or multiple parish projects for improvements for state facilities. 23The office of facility planning and control, division of administration is authorized to receive 24settlements and vendor rebates not in excess of $50,000 unless approved by the Joint 25Legislative Committee on the Budget, and to add those receipts to the funding for projects 26in this Act or any previous Capital Outlay Act for which project funds are received. The 27office of facility planning and control, division of administration is authorized to receive 28insurance payments and are hereby authorized to immediately repair facilities that suffer 29insurance losses without those projects being included in the Act and shall report to the Joint 30Legislative Committee on the Budget any expenditures from insurance funds received Page 67 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1pursuant to this section. A portion, as determined by the commissioner of administration and 2not to exceed one percent (1%), of the funding for projects which qualify for the Percent for 3Art Program and not to exceed $450,000 for an individual, qualifying project, may be 4transferred from the qualifying project budgets, to the Department of Culture, Recreation and 5Tourism for costs of acquiring art and administering the program. For all Percent for Art 6Program projects in this or any previous capital outlay, up to ten percent (10%) of the 7aforementioned one percent (1%) may be used for the costs of administering the projects. 8 Section 6. Prior to March 1, 2019, each agency authorized to administer capital 9outlay projects shall submit to the Joint Legislative Committee on Capital Outlay a list of 10projects that are completed and the cash balances remaining in each project for any 11completed project not included in the annual report submitted pursuant to R.S. 39:105 or in 12the annual reports submitted pursuant to R.S. 39:112. 13 Section 7. The commissioner of administration, with the approval of the Joint 14Legislative Committee on the Budget, is authorized to supplement or substitute the 15appropriations specified in this or previous capital outlay acts with any federal or other funds 16which are or may become available and such funds shall be deemed appropriated in specific 17amounts necessary for the purposes of this Act. Any funds received by the State Bond 18Commission as a result of a prepayment of reimbursement contracts as authorized by law 19and the policy and procedure for reimbursement contracts of the Department of Treasury, 20office of State Bond Commission, shall be deposited as set forth in such policy and 21procedure and shall be deemed available and appropriated in specific amounts necessary for 22the purposes of this Act pursuant to the procedure set forth in this section. 23 Section 8A. All of the funds herein appropriated, except for appropriations made to 24the Department of Military Affairs, the Legislature, the Louisiana Stadium and Exposition 25District, the Department of Economic Development, the Coastal Protection and Restoration 26Authority, the Division of Administration for Supplemental State Funds for Local 27Government Assistance Program, the Division of Administration for the Community Water 28Enrichment Program or the Department of Transportation and Development, shall be 29considered as having been appropriated directly to the Office of Facility Planning and Page 68 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Control, Division of Administration, and all projects herein authorized and funded shall be 2subject to the provisions of R.S. 39:101 through 128. 3 (1) Notwithstanding anything contained in this act to the contrary or any other 4provision of law, the appropriations made for the Louisiana Stadium and Exposition District 5shall be appropriated directly to the Louisiana Stadium and Exposition District, and are 6public purposes pursuant to the provisions of Article VII, Section 14 of the Constitution of 7Louisiana primarily for economic development, including the generation of tax revenue, 8creation of jobs, and the generation of tourism, and may be used to reimburse any 9expenditure made prior to the granting of a line of credit or the sale of bonds by the State 10Bond Commission, determination by the State Treasurer that cash funding has been 11deposited in the Comprehensive Capital Outlay Escrow Account for the project. 12 (2) The Louisiana Stadium and Exposition District may apply up to $10,000,000 to 13reimburse the New Orleans Pelicans NBA, LLC for costs incurred in constructing a new 14training facility as contemplated by the Amended and Restated Arena Use Agreement dated 15July, 1 2015; but, otherwise, contracts for projects funded through this appropriation shall 16be awarded utilizing the public bid and contractual review process set forth in Chapter 10 17of Title 38 and Chapter 17 of Title 39 of the Louisiana Revised Statutes of 1950, except with 18respect to time requirements, or, in order to encourage competition for the projects funded 19through this appropriation and to complete the projects in a timely manner, the Louisiana 20Stadium and Exposition District shall have the authority to select a general contractor 21through an RFP process whereby general contractors will bid general conditions and 22contractor's fee based on the direct construction budget. The alternative time requirements 23shall be approved by the Commissioner of Administration before the awarding of any such 24contracts. 25 (3) Further, with respect to appropriations to the Louisiana Stadium and Exposition 26District for the TPC Louisiana, Planning and Construction project, the Louisiana Stadium 27and Exposition District shall be permitted to use alternative competitive procurement and 28delivery methods for the award of any contracts to be funded through such appropriation. 29 (4) The Louisiana Stadium and Exposition District shall have the authority to 30directly appoint a design professional from a list of a minimum of three architectural firms Page 69 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1or joint ventures with professional sports facility design experience acceptable to the 2Commissioner of Administration and shall be exempt from other state requirements for 3selection of designers. The design professional fee shall be in accordance with state 4guidelines administered by the Office of Facility Planning and Control, Division of 5Administration. 6 Section 8B.(1)(a) All of the funds appropriated in the Capital Outlay Act under the 7name of non-state entities shall be administered by the Office of Facility Planning and 8Control, Division of Administration, under cooperative endeavor agreements. Cooperative 9endeavor agreements entered into pursuant to this Act, and approved by the Commissioner 10of Administration or his designee, or the Secretary of the Department of Transportation and 11Development for projects appropriated to or administered by the Department of 12Transportation and Development, shall not be required to be submitted to the Division of 13Administration, Office of Contractual Review. 14 (b) Further, for all projects in the Capital Outlay Act or a previous Capital Outlay 15Act which are appropriated to the Office of Facility Planning and Control, Division of 16Administration, including those administered by cooperative endeavor agreements, up to six 17percent of each line-item may be used for costs of administering the projects. 18 (c) For all projects in Capital Outlay Act or a previous Capital Outlay Act 19appropriated to the Department of Transportation and Development, up to six percent of 20each line-item may be used for costs of administering the projects, or for field 21engineering/construction supervision. 22 (2) Notwithstanding anything in this Act, or a previous Capital Outlay Act, the 23Office of Facility Planning and Control may enter into a cooperative endeavor agreement 24with the Archdiocese of New Orleans and Jefferson Parish for the Preservation and 25Restoration of Historic Structure for Hope Haven/Madonna Manor Campus, Planning and 26Construction project. 27 (3) Notwithstanding anything in this Act, or a previous Capital Outlay Act, the 28Office of Facility Planning and Control may enter into a cooperative endeavor agreement 29with Terrebonne Parish Recreation Districts Two and Three and Terrebonne Parish for the Page 70 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Terrebonne Sports Complex Phase I, Infrastructure Improvements, Acquisition, Planning 2and Construction project. 3 Section 8C. Line-item general obligation bond projects appropriated to the 4Department of Transportation and Development in the Capital Outlay Act or a previous 5Capital Outlay Act shall be authorized to draw Transportation Trust Funds from the 6Highway Program appropriation, for supplemental funding on overruns in excess of the 7original estimated project cost as determined by the Department of Transportation and 8Development, provided however that said projects are in the state or federal highway system 9and in the priority program, and the overrun is less than $50,000. Any such overrun of 10$50,000 or more must be approved by the Joint Legislative Committee on the Budget. 11 Section 8D. All ports, levee districts and other non-state entities must have a fully 12executed cooperative endeavor agreement, from the Office of Facility Planning and Control, 13Department of Transportation and Development, or the State Treasurer, whichever is 14appropriate, before entering into any contracts which obligate state funding and must follow 15all laws pertaining to public bidding. If a port, levee district or other non-state entity enters 16into a contract prior to receipt of funding, or prior to execution of a cooperative endeavor 17agreement, then payments under such contracts are prohibited from capital outlay 18appropriations, and are the sole responsibility of the port, levee district, or other non-state 19entity. 20 Section 8E. Exemptions from timing provisions for funding and execution of 21cooperative endeavor agreements and contracts 22 (1) Notwithstanding the provisions of this Act, the Capital Outlay Act, or any 23previous capital outlay act, contracts may be entered into for the Atchafalaya Basin 24Protection and Enhancement Kemper Williams project in St. Mary Parish prior to a 25cooperative endeavor agreement being entered into with the state. 26 (2) Notwithstanding anything contained in this Act, the Capital Outlay Act, or any 27previous capital outlay act to the contrary or any other provision of law, contracts may be 28entered into for the Youngsville Sports Complex project in Lafayette Parish, prior to receipt 29of funding and prior to execution of the cooperative endeavor agreement and the state is 30authorized to financially participate in obligations created by such contracts. Page 71 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1 (3) Notwithstanding anything in this Act or the Capital Outlay Act to the contrary, 2contracts may be entered into for the City of New Orleans, Eastern New Orleans Hospital 3and Medical Office Building, Real Estate Acquisition, Planning, Design, Construction, 4Renovation and Equipment project prior to receipt of funding and prior to execution of the 5cooperative endeavor agreement. 6 (4) Notwithstanding anything contained in this Act, or the Capital Outlay Act, or any 7other capital outlay act, contracts may be entered into for the Port of South Louisiana, 8Globalplex Rail Siding; Globalplex Terminal Building #71 Upgrade, Planning and 9Construction and/or Administration Building (also known as the Business Development 10Center) projects prior to receipt of funding and prior to execution of a cooperative endeavor 11agreement. 12 (5) Notwithstanding anything in this Act or the Capital Outlay Act to the contrary 13or any other provision of law, contracts may be entered into for the Greater Baton Rouge 14Port Commission Inland Rivers Marine Terminal Dock and Access Roadway Construction 15Project, Planning and Construction Project prior to receipt of funding and prior to the 16execution of a cooperative endeavor agreement. 17 (6) Notwithstanding anything in this Act or the Capital Outlay Act to the contrary 18or any other provision of law, contracts may be entered into for the Outpatient Clinics in 19Rapides Parish, Planning and Construction project for the Division of Administration prior 20to the execution of a cooperative endeavor agreement. 21 (7) Notwithstanding anything in this Act or the Capital Outlay Act to the contrary 22or any other provision of law, contracts may be entered into for the Mississippi River Levee 23Raising, Arkansas to Old River project prior to receipt of funding, and the State is authorized 24to financially participate in obligations created by such contracts. 25 (8) Notwithstanding anything in this Act or the Capital Outlay Act to the contrary 26or any other provision of law, contracts may be entered into for the Old McKinley High 27School Community Center on Thomas Delpit Drive in the City of Baton Rouge, Kitchen and 28Building Renovations, Repairs and Upgrades Including Elevator Repair Project prior to 29receipt of funding and prior to the execution of a cooperative endeavor agreement, and 30unless the Commissioner of Administration is advised by bond counsel to the state that such Page 72 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1may violate federal tax law, the appropriation may be used to reimburse any expenditure 2made prior to the granting of a line of credit or the sale of bonds by the State Bond 3Commission. 4 Section 8F. Pursuant to R.S. 39:112(E)(2), non-state entity projects shall require a 5match of not less than twenty-five percent of the total requested amount of funding; 6however, 7 (1) Notwithstanding the provisions of R.S. 39:112(E)(2), the project for 8Independence, Independence Area Community Pavilion, Planning and Construction, shall 9be exempt from all local match requirements. 10 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 11contrary, any other provisions of law, or the provisions of R.S. 39:112(E)(2), the project for 12Eden House, New Facility, Acquisition, Planning and Construction, shall be exempt from 13all local match requirements. 14 (3) Notwithstanding anything contained in this Act, the Capital Outlay Act, any 15other provision of law, or the provisions of R.S. 39:112(E)(2) to the contrary, the project for 16Lockport Street Improvements, Planning and Construction, shall be exempt from all local 17match requirements. 18 (4) Notwithstanding anything contained in this Act, any prior Capital Outlay Act, 19any other provision of law, or the provisions of R.S. 39:112(E)(2) to the contrary, the project 20for the Village of Doyline Wastewater Treatment Facility shall be exempt from all local 21match requirements. 22 Section 8G. Pursuant to R.S. 39:102, each capital outlay budget request submitted 23as required by R.S. 39:101 shall include a detailed project description and justification for 24each new project requested; however, 25 (1) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 26contrary or any other provision of law, the scope of the appropriations made in the Capital 27Outlay Act or any other Capital Outlay Act for the St. Mary Parish Plantation Pump Station 28Replacement project shall be deemed to include repair, equipment, rehabilitation and 29infrastructure improvements at the existing Plantation Pump Station. 30 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act to the Page 73 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1contrary or any other provision of law, the scope of the appropriations made in this or any 2other Capital Outlay Act for the Louisiana 4-H Foundation, Youth Education Development 3Camp Windy Wood project, shall be deemed to include planning, construction, and 4acquisition. 5 (3) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 6contrary or any other provision of law, the scope of the appropriations made in the Capital 7Outlay Act or any other Capital Outlay Act for the Youngsville Parkway Road project shall 8be deemed to include waterline improvements and roadway lighting. 9 (4) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 10contrary, or any other provision of law, the scope of the appropriations made in the Capital 11Outlay Act or any other Capital Outlay Act for the City of New Orleans, Eastern New 12Orleans Hospital and Medical Office Building, Real Estate Acquisition, Planning, Design, 13Construction, Renovation and Equipment project, the City of New Orleans may make such 14capital outlay funds available to the Parish Hospital Service District of the Parish of Orleans 15District "A" in furtherance of the District's planning, design, acquisition, development, 16renovation, construction, equipment and operation of a hospital and medical office building 17in Eastern New Orleans. 18 (5) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 19contrary or any other provision of law, the scope of the appropriations made in the Capital 20Outlay Act or any other Capital Outlay Act for the Jefferson Parish Bonnabel Canal 21Rehabilitation and Bank Stabilization (Veterans Boulevard to West Esplanade), Planning 22and Construction project shall be deemed to include steel sheet pile bulkhead, and/or bank 23excavation and reshaping, bridge replacement, property acquisition, demolition and 24improvements needed to stabilize the canal bank along the Bonnabel Drainage Canal in 25order to address canal bank failures between Veterans Boulevard and West Esplanade 26Avenue. 27 (6) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 28contrary or any other provision of law, the scope of the appropriations made in this or any 29other Capital Outlay Act for the New Orleans West Bank Park Improvements, New Soccer 30and Recreational Facilities, and Skateboard Park project and the Norman Playground Page 74 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Basketball Gym, Planning and Construction project shall be deemed to include the George 2W. Carver Playground, Renovations and Upgrades project for the West Bank Park project 3and park enhancements for a walking track, basketball, football and baseball fields and a 4concession stand for the Norman Playground project. 5 (7) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 6contrary or any other provision of law, the Parks Municipal Complex, Planning and 7Construction project shall include the purchase, construction or renovation of a new facility 8in St. Martin Parish. 9 (8) Notwithstanding anything contained in this Act or the Capital Outlay Act to the 10contrary or any other provision of law, The Vernon/Fort Polk Thoroughfare Electrical Power 11Extension project shall include Utilities Including Generators. 12 (9) Notwithstanding anything in this Act, the Capital Outlay Act, any previous 13capital outlay act, or other provision of law to the contrary, the scope of the appropriation 14for the Port of South Louisiana Globalplex Terminal Building #71 Upgrade project shall be 15deemed to also include similar upgrades for other Globalplex Terminal Buildings. 16 (10) Notwithstanding anything contained in this Act, the Capital Outlay Act, or any 17other provision of law to the contrary, the scope of the appropriation for the Department of 18Transportation and Development, LA 22 Improvements (LA 16 to Diversion Canal), 19Planning and Construction (Livingston) is deemed to also include the overlay of LA 22 from 20Head of Island to Chinquapin Bridge. 21 (11) Notwithstanding anything contained in the Act or a previous Capital Outlay 22Act, any provision of law, or in any cooperative endeavor agreement between the Office of 23Facility Planning and Control and Westwego, the scope of the appropriations in this or any 24previous Capital Outlay Act for Westwego, The WHARF project shall be deemed to include 25site preparation. 26 (12) Notwithstanding anything contained in the Act or the Capital Outlay Act to the 27contrary or any other provision of law, the Slip Dredging and Improvements for the 28Terrebonne Port Commission Government Multi-Use Complex, Planning and Construction 29project shall be deemed to include Houma Navigation Canal Dredging. 30 (13) Notwithstanding anything contained in this Act or a previous Capital Outlay Page 75 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Act, any provision of law, or in any cooperative endeavor agreement between the Office of 2Facility Planning and Control and the Pontchartrain Levee District, the scope of the 3appropriations in this or any previous Capital Outlay Act for the Pontchartrain Levee 4District, East St. Charles Urban Flood Control project shall be deemed to include planning, 5design, and construction of the East St. Charles Urban Flood Control project, including the 6Almedia, St. Rose, and Airport Pump Stations located in the eastern end of the East Bank 7of St. Charles Parish. 8 (14) Notwithstanding anything contained in this Act, the Capital Outlay Act, or any 9other Capital Outlay Act, the scope of the appropriation for the Department of 10Transportation and Development, Jimmie Davis Bridge Rehabilitation and Lighting, 11Planning and Construction project in Bossier and Caddo parishes, shall be deemed to include 12the planning, design and construction of a new bridge. 13 Section 8H. Notwithstanding anything contained in this Act or the Capital Outlay 14Act, or in any cooperative endeavor agreement between the Office of Facility Planning and 15Control and the City of New Orleans or the Hospital Service District to the contrary, the 16Hospital Service District may mortgage or otherwise encumber any and all land, real estate 17property, including buildings and equipment, and appurtenances acquired, in whole or part, 18with state capital outlay funds provided that bond counsel to the state opines that such 19mortgage shall not affect the tax-exempt status of the bonds to be issued by the state for the 20project. 21 Section 8I. Notwithstanding anything contained in this Act or the Capital Outlay Act 22to the contrary or any other provision of law, the Parish Road Improvements Project for 23Franklin Parish is exempt from the contract limit set forth in R.S. 38:2212. 24 Section 8J. Notwithstanding anything contained in this Act or the Capital Outlay Act 25to the contrary or any other Act or provision of law, the appropriations made for the 26Executive Department for facilities which promote economic development included in the 27Repair, Restoration, and Replacement for Hurricanes Katrina and Rita project, and the 28Department of Economic Development projects are for public purposes pursuant to the 29provisions of Article VII, Section 14 of the Constitution of Louisiana primarily for economic 30development, including the generation of tax revenues, creation of jobs, promotion of Page 76 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1tourism, and creation of facilities for charitable, cultural, artistic, educational, social, civic, 2research, service, economic development activities, or provide facilities for professional golf 3events, pursuant to the terms of cooperative endeavor agreements, including leases and all 4expenditures of these appropriations and may be exempted, by the Commissioner of 5Administration, from all statutes relative to public bidding, contractual review and the 6provisions of R.S. 33:9029.2(D) and in lieu thereof be allowed to use alternative competitive 7contracting arrangements where the appropriate administering entity submits documentation 8to the Commissioner of Administration substantiating that it is in the best interest of the 9citizens of the state, due to economic and/or operational benefits, and the necessity to 10complete the projects in a timely manner; and, the appropriate administering entity shall 11have the authority to directly appoint the design professional from a list of a minimum of 12three design firms or joint ventures with the appropriate specialized facility design 13experience submitted to and acceptable to the Commissioner of Administration and shall be 14exempt from other state requirements for selection of designers, and may include 15expenditures for computers, fixtures, furniture, and other equipment as such is deemed to 16be capital outlay in nature, and unless the Commissioner of Administration is advised by 17bond counsel to the State that such may violate federal tax law, may be used to reimburse 18any expenditure made prior to the granting of a line of credit or the sale of bonds by the State 19Bond Commission, determination by the State Treasurer that cash funding has been 20deposited in the Comprehensive Capital Outlay Escrow Account for the project or the 21execution of a cooperative endeavor agreement from the Office of Facility Planning and 22Control, and may be used to acquire land or real property, the title to which is held in the 23name of an entity exempt from taxation under the provisions of 26 U.S.C. 501(c)(3). 24 Section 8K. Notwithstanding anything contained in this Act or the Capital Outlay 25Act to the contrary or any other provision of law, all of the funds herein appropriated to the 26Department of Economic Development in connection with the Capital Improvements Project 27to Meet Economic Development Commitments for which the Department of Economic 28Development utilizes a cooperative endeavor agreement to further economic development 29as permitted under Article VII, Section 14 of the Louisiana Constitution, including the 30generation of tax revenues and creation of jobs, shall be considered as having been Page 77 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1appropriated to the Department of Economic Development, may be used to reimburse any 2expenditure made prior to the granting of a line of credit and made prior to the execution of 3a cooperative endeavor agreement and shall be administered solely by the Department of 4Economic Development pursuant to, in compliance with, and on the terms contained in such 5cooperative endeavor agreements. 6 Section 8L. Notwithstanding any other provision of this Act or the Capital Outlay 7Act or any other provision of law to the contrary, all of the funds herein appropriated to the 8Department of Economic Development in connection with projects or programs for which 9the Department of Economic Development utilizes a cooperative endeavor agreement to 10further economic development as permitted under Article VII, Section 14 of the Louisiana 11Constitution, including the generation of tax revenues and creation of jobs, shall be 12considered as having been appropriated to the Department of Economic Development, may 13be used to reimburse any expenditure made prior to the granting of a line of credit and made 14prior to the execution of a cooperative endeavor agreement and shall be administered solely 15by the Department of Economic Development pursuant to, in compliance with, and on the 16terms contained in such cooperative endeavor agreements without compliance with any other 17law, including, but not limited to, the provisions of R.S. 39:101 through 128. Additionally, 18all expenditures of these appropriations may be exempted by the Commissioner of 19Administration, from all statutes relative to public bidding, contractual review and the 20provisions of R.S. 33:9029.2(D). 21 Section 8M.(1) Notwithstanding any other provision of this Act or the Capital 22Outlay Act or any other provision of law to the contrary, funds appropriated for the 23Economic Development Award Program project for the Office of Business Development 24are to be used solely for capital and infrastructure improvements subject to verification by 25the Division of Administration, Office of Facility Planning and Control. 26 (2) Eligible expenses for Economic Development Award Program funds may include 27documented project expenses beginning on the date of LEDC Board approval of the project 28and may be reimbursed upon execution of the cooperative endeavor agreement for the 29project. Page 78 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1 Section 8N. Notwithstanding any provision of law to the contrary, the Commissioner 2of Administration is hereby authorized to take such actions as are necessary, including using 3such funds as may be available including those appropriated and available under this Act or 4the Capital Outlay Act for professional sports facilities through the Louisiana Stadium and 5Exposition District and that are otherwise available, executing on behalf of the State such 6documents as are necessary in order to terminate the ground lease between the State and the 7PGA and thereby acquiring all leasehold improvements for the State, extending the 8management agreement between the State and the PGA, and extending the sponsorship and 9presence of the Zurich Classic in the Greater New Orleans area. 10 Section O. Notwithstanding anything in this Act, any previous capital outlay act, or 11other provision of law to the contrary, monies appropriated herein for the Port of South 12Louisiana Globalplex Terminal Building #71 and Other Globalplex Terminal Building 13Upgrades, Planning and Construction may be expended for design fees related to the 14conveyor system and ancillary equipment that exceed the customary ten percent limitation 15on design fee costs. 16 Section P. Notwithstanding anything in this Act to the contrary or any other 17provision of law, monies appropriated herein for the Juban Road (LA1026) Widening (I-12 18to US 190) project may be expended for the installation of sewer lines along the roadway 19and pursuant to a cooperative endeavor agreement between the Department of 20Transportation and Development and Livingston Parish, funds may be provided to 21Livingston Parish for that purpose. 22 Section 8Q. The new University Medical Center in New Orleans project in Orleans 23Parish shall be exempt from the state's requirements for selection of designers and the 24Commissioner of Administration shall have the authority to approve a design professional 25selection process. The design professional fee shall be in accordance with state guidelines 26administered by the Office of Facility Planning and Control, Division of Administration. 27 Section 8R.(1) The Division of Administration, Office of Facility Planning and 28Control, with approval of the Commissioner of Administration and the Joint Legislative 29Committee on the Budget, is authorized to use alternative delivery strategies in 30implementing hurricane damage repairs to Southern University at New Orleans, Hazardous Page 79 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Material Abatement Projects, the City Park Golf Complex Improvements project, the 2Health/Human Performance Education Complex, and the Patrick Taylor Hall Renovation 3and Expansion project. 4 (2) In addition, with the approval of the Commissioner of Administration and the 5Joint Legislative Committee on the Budget, an alternative delivery strategy may be used in 6the implementation of the Louisiana Children's Museum, Early Learning Village project. 7 Section 8S.(1) Due to the State's current investment in TPC Louisiana and the 8financial support it provides to the PGA TOUR event currently played at said facility, the 9funding of the City Park Golf Complex Improvements project described above is 10conditioned upon said PGA TOUR event not being played at New Orleans City Park Golf 11Complex without the prior agreement of the Commissioner of Administration and the 12Chairman of the Jefferson Parish Council. 13 (2) Notwithstanding the foregoing, the City Park Golf Complex may host any other 14golf tournament or event, including but not limited to any other PGA-affiliated or sponsored 15tournament or event. 16 Section 8T.(1) For all projects administered by the Office of Facility Planning and 17Control and payable from proceeds of self-generated revenues, funds shall be remitted to the 18Office of Facility Planning and Control for deposit in the state treasury at such time as may 19be deemed necessary by the Office of Facility Planning and Control in order to cover the 20amount of contracts or other project expenses. 21 (2) Notwithstanding any provisions contained herein or any other law to the contrary, 22for projects with other means of financing provided to the administering agency by 23interagency transfer, the authority to draw these funds shall remain with the user agency. 24 (3) Any revenue bonds appropriated in Section 1 of the Capital Outlay Act shall not 25be secured by the full faith and credit of the state. 26 (4) The State Treasurer shall refund to the appropriate source any surplus self- 27generated funds, advanced insurance funds received by the Office of Facility Planning and 28Control as Interagency Transfer from Office of Risk Management associated with hurricane 29damage recovery, and interest earned on these funds, provided the Treasurer's Office is Page 80 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1notified, when these funds are deposited in the state treasury, that the user agency or Office 2of Risk Management intends to request a refund of this interest. 3 Section 8U.(1) Notwithstanding anything in this Act or the Capital Outlay Act to 4the contrary or any other provision of law, contracts may be entered into for the Tulane 5University Tulane River and Coastal Center Project prior to receipt of funding and prior to 6the execution of a cooperative endeavor agreement, and the project is exempted from all 7statutes relative to public bidding and state procurement and in lieu thereof shall be subject 8to federal government qualifications and regulations approved by the Economic 9Development Authority. 10 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act or any 11other provision of law to the contrary, contracts may be entered into for the City of Gretna’s 12Lion’s Club Conversion to Senior Center project prior to receipt of funding and prior to 13execution of a cooperative endeavor agreement and the project is exempted from all statutes 14relative to public bidding and contractual review. 15 Section 8V. Notwithstanding anything contained in this Act, the Capital Outlay Act, 16or any other provision of law to the contrary, the letting of a contract for construction of the 17"Louisiana Construction Center", funded wholly by the Louisiana Licensing Board for 18Contractors, shall be exempt from all statutes relative to public bidding and contractual 19review. 20 Section 8W. Notwithstanding anything contained in this Act, the Capital Outlay Act, 21or any other provision of law to the contrary, the Department of Transportation and 22Development shall use $2,500,000 of general obligation bond funding appropriated for 23Department of Transportation and Development, Administration, Highway Program (Up to 24$4,000,000 for Secretary's Emergency Fund) in Act 25 of the 2014 Regular Session of the 25Legislature for the Louisiana Highway 92 Overlay, Preservation and Construction 26(Lafayette) project. 27 Section 8X. Notwithstanding anything contained in this Act, the Capital Outlay Act, 28or any other provision of law to the contrary, $50,000 of the appropriation for Department 29of Natural Resources, Office of the Secretary, Atchafalaya Basin Protection and 30Enhancement (Federal Match and Local/Sponsor Match)(Assumption, Avoyelles, Iberia, Page 81 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1Iberville, Pointe Coupee, St. Landry, St. Martin, St. Mary) will be used to fund House 2Concurrent Resolution No. 168 of 2011. 3 Section 9. Notwithstanding any provisions contained herein or any other law to the 4contrary, the provisions of Chapter 16 of Subtitle III of Title 39 of the Louisiana Revised 5Statutes of 1950 as amended, shall not apply to architectural and engineering contracts, 6administered by the office of facility planning and control, division of administration 7pursuant to this or any other capital outlay act. 8 Section 10. All funds appropriated herein to the office of facility planning and 9control, division of administration, on behalf of non-state entities, and administered by 10cooperative endeavor agreements pursuant to this Act shall be expended within two (2) years 11from the date of the issuance of the bonds. The office of facility planning and control, 12division of administration, agrees that it will notify the non-state entity of the date the bonds 13are issued within three (3) months from the issuance thereof. The non-state entity 14understands and agrees that if the funds appropriated herein and administered under 15cooperative endeavor agreements pursuant to this Act are not totally expended within two 16(2) years from the issuance of the bonds, the office of facility planning and control, division 17of administration, can close the project and recommend that the legislature reallocate any 18unexpended proceeds to other projects. 19 Section 11. Notwithstanding any provisions contained herein or law to the contrary, 20the proceeds of revenue bonds to be utilized to fund certain projects authorized in Section 211 hereof may, in accordance with Article VII, Section 9 of the Louisiana Constitution of 221974, be deposited in special accounts held outside the state treasury in accordance with the 23provisions of any bond resolution, indenture, reimbursement contract, or other bond or 24financing covenant which provides for the pledge of such funds in connection with the 25issuance of revenue bonds. For all projects administered by the office of facility planning 26and control, division of administration, authorized in Section 1 hereof which are payable 27from the proceeds of revenue bonds, only the office of facility planning and control, division 28of administration, will be authorized to requisition funds from the special accounts described 29immediately above, at such time or times as may be deemed necessary by the office of Page 82 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1facility planning and control, division of administration, in order to cover contract amounts 2or other project expenses. 3 Section 12. The governor shall have the power to veto any line-item in this Act. 4 Section 13. Except as otherwise provided herein, no funds shall be expended on any 5highway projects on highways within the state highway system as established in R.S. 48:191 6under the jurisdiction of the Department of Transportation and Development unless and until 7such project is in the Highway Program, R.S. 48:228 through 232, approved by the Joint 8Legislative Committee on Transportation, Highways and Public Works. Pursuant to R.S. 949:214.6.2(B), no integrated coastal protection construction project shall be undertaken with 10funds included in this bill except those included in an annual plan finally approved by the 11legislature in accordance with the provisions of R.S. 49:214.5.3. No funds appropriated to 12the Coastal Protection and Restoration Authority in this Act as a contribution for a project 13cost-share or otherwise, for the national economic development and national ecosystem 14restoration components of the Southwest Coastal Louisiana Study shall be used or provided 15for the expropriation of property or use of eminent domain, except where such funds are to 16be used to obtain property voluntarily offered for project purposes, where at least seventy- 17five percent of the owners have voluntarily offered the property, or where the record or 18apparent owners have voluntarily offered the property but do not have clear title. 19 Section 14. The word "statewide" used in place of the specific parish designation for 20projects contained in this Act indicates that the project or program is applicable to all sixty- 21four parishes in the state. The description of any project in this Act shall be deemed to 22include planning, design, master planning, studies, permits, surveys, testing, construction, 23land and/or building/improvement acquisition, reconstruction, renovation, repair, right of 24way and utilities, site and other improvements, miscellaneous/contingencies, lease hold 25improvements ultimately owned by the state or a political subdivision of the state, equipment 26and other acquisitions, and any other component of the project if such are included or 27indicated in the capital outlay request for such projects required by R. S. 39:101 subject to 28the provisions of Title 39 of the Louisiana Revised Statutes. For new construction or 29renovation projects, equipment or other acquisitions, which can reasonably be considered 30necessary for the facility to be functional, may be deemed to be included in the project, even Page 83 of 85 HLS 18RS-498 ORIGINAL HB NO. 2 1if such equipment or other acquisitions are not included or indicated in the project name or 2the capital outlay request. When local or federal match is referenced in a project title, but 3only a portion of the state appropriation is granted a line of credit or otherwise funded, then 4the amount of local or federal match, required to be made available, may be prorated relative 5to the amount of state appropriation made available through lines of credit. 6 Section 15. The provisions, items, and projects contained in this Act are severable 7and if any provision, item, or project contained herein, or the application of any such 8provision, item, or project, is held invalid, such invalidity shall not affect other provisions, 9items, projects, or applications of the Act which can be given effect without the invalid 10provision, project, item, or application. 11 Section 16. Notwithstanding any other provisions of law to the contrary, the state 12shall not grant cash lines of credit, or authorize or issue general obligation bonds in a 13principal amount in excess of $965,210,000 for Fiscal Year 2018-2019. 14 Section 17. Notwithstanding any contrary provision of this Act or any contrary 15provision of law, no funds appropriated by this Act shall be released or provided to any 16recipient of an appropriation made in this Act if, when, and for as long as, the recipient fails 17or refuses to comply with the provisions of R.S. 24:513. The legislative auditor is authorized 18to grant an extension of time to comply with the provisions of R.S. 24:513 for recipient 19entities of an appropriation contained in this Act. No recipient shall be considered to fail 20or refuse to comply with the provisions of R.S. 24:513 pursuant to this Section during any 21extension of time granted by the legislative auditor to the recipient to comply. 22 Section 18. This Act shall become effective upon signature by the governor or, if not 23signed by the governor, upon expiration of the time for bills to become law without signature 24by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 25vetoed by the governor and subsequently approved by the legislature, this Act shall become 26effective on the day following such approval.
