HOUSE BILL NO. 235
BY REPRESENTATIVE HILFERTY
ALCOHOLIC BEVERAGES:  Provides relative to the educational requirements of the ATF
Responsible Vendor Program for bartenders and servers
1	AN ACT
2To enact R.S. 26:933(C)(9), relative to the Responsible Vendor Program; to provide relative
3 to the curriculum of the server training course; to provide for training on matters of
4 sexual assault, rape, sexual harassment, and sex trafficking; to provide for the
5 contents of the training; to provide relative to the development of the curriculum; and
6 to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 26:933(C)(9) is hereby enacted to read as follows: 
9 ยง933.  Establishment of responsible vendor program

11	C.  The server training courses shall include but not be limited to the
12 following subject areas:

14	(9)(a)  Methods of identifying and responding to sexual assault, rape, sexual
15 harassment, and sex trafficking.
16	(i)  Definitions of rape, sexual assault, sexual harassment, and sex trafficking.
17	(ii)  Potential responses of vendors in the event a sexual assault, rape, sexual
18 harassment, and sex trafficking occurs on the premises.
19	(iii)  Effects of rape, sexual assault, sexual harassment, and sex trafficking
20 on primary and secondary victims.

1	(iv)  Updated information on the physical appearance of drugs, the effects of
2 drugs, street names for drugs, and methods of delivery as it relates to rape, sexual
3 assault, sexual harassment, and sex trafficking.
4	(v)  Victims rights in accordance with the provisions of R.S. 40:1216.1, R.S.
5 46:1841 et seq., and any other applicable law.
6	(b)  The program administrator shall consult with appropriate governmental
7 and nongovernmental agencies statewide in the development and presentation of the
8 training required by this Paragraph and shall develop a curriculum that is based on
9 evidence based practices and guidance from a provider that conducts forensic
10 medical examinations.

Abstract:  Requires the Responsible Vendor Program to amend the server curriculum to
include training regarding methods of identifying and responding to rape, sexual
assault, sexual harassment, and sex trafficking.
Present law creates the Responsible Vender Program and the curriculum for server and
security personnel training.
Proposed law requires training regarding rape, sexual assault, sexual harassment, and sex
trafficking.  Additionally, training shall include current information regarding drugs and the
method of delivery as it relates to rape, sexual assault, sexual harassment, and sex
trafficking.  The program administrators shall develop a curriculum that uses evidence based
practices and guidance from a provider that handles forensic medical examinations.
