HOUSE BILL NO. 260

CRIME/DNA:  Provides relative to DNA collection for certain offenses
1	AN ACT
2To enact R.S. 15:603(10)(r) and (s), relative to DNA detection of sexual and violent
3 offenders; to provide for the collection of DNA samples from certain offenders; to
4 provide for certain crimes requiring the collection of DNA samples; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 15:603(10)(r) and (s) are hereby enacted to read as follows: 
8 ยง603.  Definitions
9	For purposes of this Chapter, the following terms shall have the following
10 meanings:

12	(10)  "Other specified offense" means a commission of the following:

14	(r)  A violation of R.S. 14:43.1.1.
15	(s)  A second or subsequent violation of R.S. 14:95.8.

17 Section 2. The Louisiana State Law Institute shall place the offenses included in
18provisions of R.S. 15:603(10) as enacted in this Act in numerical order with other offenses
19listed in R.S. 15:603(10).

Abstract:  Adds misdemeanor sexual battery and the second or subsequent violation of
illegal possession of a handgun by a juvenile to the list of offenses that require
collection of a DNA sample.
Present law provides for DNA samples to be taken from the offender of a felony or any of
the following offenses: battery of a police officer; battery of a school teacher; battery of a
school or recreation athletic contest official; battery of a correctional facility employee;
simple battery; simple battery of a child welfare or adult protective service worker; simple
battery of persons with infirmities; aggravated assault; unlawful use of a laser on a police
officer; simple assault; assault on a school teacher; stalking; identity theft; misdemeanor
carnal knowledge of a juvenile; prohibited sexual conduct between educator and student;
prostitution; soliciting for prostitutes; inciting prostitution; prostitution by massage;
massage, sexual conduct prohibited; letting premises for prostitution; contributing to the
delinquency of juveniles; hate crimes; letting premises for obscenity; peeping tom; and
inciting a riot.
Proposed law adds to this list misdemeanor sexual battery and the second or subsequent
violation of illegal possession of a handgun by a juvenile.
