HLS 18RS-692 ORIGINAL 2018 Regular Session HOUSE BILL NO. 287 BY REPRESENTATIVE EDMONDS ABORTION: Provides relative to laws concerning abortion based on genetic abnormality 1 AN ACT 2To enact R.S. 40:1061.1.2(C)(3), relative to the prohibition on abortion based on genetic 3 abnormality; to provide relative to information to be conveyed to a woman prior to 4 an abortion; to provide relative to violations of law pertaining to the furnishing of 5 such information; to limit the assessment of penalties in connection with such law; 6 and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 40:1061.1.2(C)(3) is hereby enacted to read as follows: 9 ยง1061.1.2. Abortion based on genetic abnormality; prohibition 10 * * * 11 C. 12 * * * 13 (3) No person shall be found in violation of this Subsection, and no penalty 14 for a violation of this Subsection shall be assessed, in any instance in which the 15 informational document required by this Subsection is not available for use. 16 * * * 17 Section 2. This Act shall become effective upon signature by the governor or, if not 18signed by the governor, upon expiration of the time for bills to become law without signature 19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law prohibits intentionally performing or attempting to perform an abortion of an unborn child of less than 20 weeks post-fertilization age without first providing the pregnant woman with an informational document including resources, programs, and services for pregnant women who have a diagnosis of fetal genetic abnormality and resources, programs, and services for infants and children born with disabilities. Proposed law retains present law. Proposed law stipulates that no person shall be found in violation of present law, and no penalty for a violation of present law shall be assessed, in any instance in which the required informational document is not available for use.
