ENROLLED 2018 Regular Session HOUSE BILL NO. 4 BY REPRESENTATIVE BISHOP 1 AN ACT 2 To amend and reenact R.S. 56:10(B)(1)(g)and (16)(a) and 302.1(C)(1)(c) and to enact R.S. 3 56:10(B)(16)(d) and 639.8(E)(4), relative to saltwater fishing licenses; to extend the 4 applicability of an additional fee for purchase of a saltwater fishing license; to allow 5 for the increase of an additional fee for purchase of a saltwater fishing license; to 6 provide for the sources of revenue for a saltwater fish stock estimate; to require an 7 annual report to certain legislative committees; to provide for an effective date; and 8 to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 56:10(B)(1)(g) and (16)(a) and 302.1(C)(1)(c) are hereby amended 11 and reenacted and R.S. 56:10(B)(16)(d) and 639.8(E)(4) are hereby enacted to read as 12 follows: 13 §10. Annual report to governor; estimate of proposed expenditures; particular funds; 14 limitations on purposes for use of monies in particular funds; warrants; 15 vouchers; surplus funds 16 * * * 17 B.(1) Subject to the exception contained in Article VII, Section 9(A) of the 18 Constitution of Louisiana, all funds collected by the commission from every source 19 shall be paid into the state treasury and shall be credited to the Bond Security and 20 Redemption Fund. Out of the funds remaining in the Bond Security and Redemption 21 Fund after a sufficient amount is allocated from that fund to pay all obligations 22 secured by the full faith and credit of the state which become due and payable within Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 4 ENROLLED 1 any fiscal year, the treasurer shall, prior to placing such remaining funds in the state 2 general fund, conform to the following: 3 * * * 4 (g) Between June 1, 2014, and May 31, 2018 2022, pay annually into 5 the Conservation Fund, into a special account designated as the "Saltwater 6 Fish Research and Conservation Fund", an amount equal to the fees collected 7 pursuant to R.S. 56:302.1(C)(1)(c). 8 * * * 9 (16)(a) The monies in the Saltwater Fish Research and Conservation Fund 10 shall be used solely for the administration and conducting of the Louisiana 11 Recreational Creel Survey (LACREEL), and the Recreational Offshore Landing 12 Permit program (ROLP), and the saltwater fish stock estimate. 13 * * * 14 (d) The department shall make an annual report to the Senate Committee on 15 Natural Resources and the House Committee on Natural Resources and Environment 16 on the progress and effectiveness of LACREEL and the saltwater fish stock estimate. 17 * * * 18 §302.1. Annual license; temporary license; fees; saltwater fee; exemptions 19 * * * 20 C.(1) 21 * * * 22 (c) Between June 1, 2014, and May 31, 2018 2022, in addition to the fee 23 required by Subparagraph (a) of this Paragraph for purchase of a saltwater fishing 24 license, there shall be an additional fee of seven dollars and fifty cents to be paid for 25 each license purchased by a resident that shall be credited to the Saltwater Fish 26 Research and Conservation Fund, R.S. 56:10(B)(1)(g). The commission is 27 authorized to increase the additional fee to an amount not to exceed nine dollars and 28 fifty cents. Department of Wildlife and Fisheries; Artificial Reef Development Fund 2 * * * 3 E.(1) 4 * * * 5 (4) In addition to the expenditures authorized in Paragraphs (1), (2), and (3) 6 of this Subsection and prior to depositing expenditures authorized in Paragraphs (1), 7 (2), and (3) of this Subsection, an amount not to exceed two million dollars of the 8 fund may be used by the department for the administration and conducting of the 9 saltwater fish stock estimate. 10 * * * 11 Section 2. This Act shall become effective upon signature by the governor or, if not 12 signed by the governor, upon expiration of the time for bills to become law without signature 13 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 14 vetoed by the governor and subsequently approved by the legislature, this Act shall become 15 effective on the day following such approval.
