RÉSUMÉ DIGEST ACT 209 (HB 443) 2018 Regular Session Smith Existing law requires that upon seeking treatment for a sexually-oriented criminal offense, a victim has the right to refuse to report the incident to law enforcement. New law retains existing law. Prior law required that a hospital or healthcare provider report a sexually-oriented criminal offense to law enforcement if the victim is 16 years of age or younger. New law increases the age from 16 to 17. Effective August 1, 2018. (Amends R.S. 40:1216.1(A)(4)(a))
