HOUSE BILL NO. 493

JUDGES:  Provides relative to the Judicial Council of the Supreme Court of Louisiana
1	AN ACT
2To amend and reenact R.S. 13:62(B), relative to the Judicial Council of the Supreme Court
3 of Louisiana; to provide for the content of recommendations made by the council to
4 the legislature; to provide for the deadlines relative thereto; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 13:62(B) is hereby amended and reenacted to read as follows: 
8 ยง62.  Court costs and fees; submission to Judicial Council; recommendation

10	B.  No law to provide for a new court cost or fee or to increase an existing
11 court cost or fee shall be enacted unless first submitted to the Judicial Council for
12 review and recommendation to the legislature as to whether the court cost or fee is
13 reasonably related to the operation of the courts or court system.  A copy of the
14 proposal for a new or increased court cost or fee shall be submitted to the Judicial
15 Council no later than January October fifteenth of the calendar year in which before
16 the proposal is intended to be introduced in the legislature, and a copy shall be
17 provided to the legislature, through the clerk of the House of Representatives and the
18 secretary of the Senate, at the time it is submitted to the Judicial Council for review. 
19 The Judicial Council shall notify the legislature of its recommendation, through the

1 clerk of the House of Representatives and the secretary of the Senate, by March
2 fifteenth first of that same each year.

Abstract: Eliminates required content in recommendations by the Judicial Council of the
Supreme Court of La. (the council) relative to laws creating or increasing court costs
or fees and provides earlier deadlines for submission of laws to the council for its
review and for notification of the council's recommendations to the legislature.  
Present law provides that laws providing for a new or increased court cost or fee shall only
be enacted if they are first submitted to the council for review and recommendation to the
legislature as to whether the court cost or fee is reasonably related to the operation of the
courts or court system. Proposed law removes the requirement that the council's
recommendation address whether the court cost or fee is reasonably related to the operation
of the courts or court system.
Proposed law changes the deadline for submitting a copy of the proposal to the Judicial
Council from Jan. 15
