HLS 18RS-884 ORIGINAL 2018 Regular Session HOUSE BILL NO. 496 BY REPRESENTATIVE HAZEL MTR VEHICLE/DRIVER LIC: Provides for a voluntary fee on driver's license applications to benefit the Military Family Assistance Fund 1 AN ACT 2To amend and reenact R.S. 32:412(A)(1), (2), (5), (6), (B)(1), (2), (7)(e)(i)(aa), (dd)(I), 3 (ii)(aa), and (dd)(I) and R.S. 46:122(A)(1) and to enact R.S. 32:412(A)(8) and 4 (B)(10), relative to driver's license fees; to provide for a one dollar increase in 5 driver's license fees applicable to certain driver's licenses; to provide for a voluntary 6 donation to the Louisiana Military Family Assistance Fund; and to provide for 7 related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 32:412(A)(1), (2), (5), (6), (B)(1), (2), (7)(e)(i)(aa), (dd)(I), (ii)(aa), 10and (dd)(I) are hereby amended and reenacted and R.S. 32:412(A)(8) and (B)(10) are hereby 11enacted to read as follows: 12 §412. Amount of fees; credit or refund; duration of license; veteran designation; 13 disabled veteran designation; university logo; "I'm a Cajun"designation; 14 disbursement of funds; renewal by mail or electronic commerce of Class "D" 15 or "E" drivers' licenses; disposition of certain fees; exception 16 A.(1) Every applicant for a Class "D" driver's license, or for a renewal of a 17 Class "D" driver's license, except those bona fide residents of the city of New 18 Orleans, shall pay for such basic license a fee of forty-two forty-three dollars and 19 seventy-five cents. One dollar and fifty cents of the fee 2 shall be forwarded by the department to the litter abatement and education account 3 which is created with the Conservation Fund through the provisions of R.S. 4 56:10(B)(15). 5 (2) The fee for Class "D" driver's licenses, or renewal of a Class "D" driver's 6 license, issued to bona fide residents of the city of New Orleans shall be fifty-four 7 fifty-five dollars, fifteen dollars of which shall be payable by the department to the 8 board of trustees of the police pension fund of the city of New Orleans. One dollar 9 and eighty-four cents of the fee shall be paid to the Louisiana State Police Retirement 10 System Fund. One dollar and fifty cents of the fee shall be forwarded by the 11 department to the litter abatement and education account which is created within the 12 Conservation Fund through the provisions of R.S. 56:10(B)(15). 13 * * * 14 (5) Every applicant for a Class "E" driver's license, or for a renewal of a 15 Class "E" driver's license, except those bona fide residents of the city of New 16 Orleans, shall pay for such basic license a fee of twenty twenty-one dollars and 17 twenty-five cents, which shall be the cost of such basic license. Five dollars and 18 sixty-three cents of the fee shall be paid to the Louisiana State Police Retirement 19 System Fund. One dollar and fifty cents of the fee shall be forwarded by the 20 department to the litter abatement and education account which is created within the 21 Conservation Fund through the provisions of R.S. 56:10(B)(15). 22 (6) The fee for a Class "E" driver's license, or renewal of a Class "E" driver's 23 license, issued to bona fide residents of the city of New Orleans shall be twenty 24 twenty-one dollars and twenty-five cents, three dollars and seventy-five cents of 25 which fee shall be paid by the department to the board of trustees of the police 26 pension funds of the city of New Orleans. Three dollars and seventy-five cents of 27 the fee shall be paid to the Louisiana State Police Retirement System Fund. HLS 18RS-884 ORIGINAL HB NO. 496 1 abatement and education account which is created within the Conservation Fund 2 through the provisions of R.S. 56:10(B)(15). 3 * * * 4 (8) An applicant may choose to donate one dollar of the license fee required 5 by this Subsection to the Louisiana Military Family Assistance Fund. 6 * * * 7 B.(1) Every applicant for a Class "A", "B", or "C" commercial driver's 8 license, or for a renewal of a basic Class "A", "B", or "C" commercial driver's 9 license, except for those bona fide residents of the city of New Orleans, shall pay for 10 such basic license a fee of sixty-one sixty-two dollars and fifty cents. Sixteen dollars 11 and twenty cents of the fee shall be paid to the Louisiana State Police Retirement 12 System Fund. One dollar and fifty cents of the fee shall be forwarded by the 13 department to the litter abatement and education account which is created within the 14 Conservation Fund through the provisions of R.S. 56:10(B)(15). 15 (2) The fee for a basic Class "A", "B", or "C" commercial driver's license, 16 or for the renewal of a basic Class "A", "B", or "C" commercial driver's license, 17 issued to bona fide residents of the city of New Orleans shall be seventy-six 18 seventy-seven dollars and fifty cents, fifteen dollars of which fee shall be paid by the 19 department to the board of trustees of the police pension fund of the city of New 20 Orleans. Fifteen dollars of the fee shall be paid to the Louisiana State Police 21 Retirement System Fund. One dollar and fifty cents of the fee shall be forwarded by 22 the department to the litter abatement and education account which is created with 23 the Conservation Fund through the provisions of R.S. 56:10(B)(15). 24 * * * 25 (7) 26 * * * 27 (e)(i)(aa) Every applicant seventy years of age or older for a Class "E" 28 driver's license, or for the renewal of a Class "E" driver's license, except those bona 29 fide residents of the city of New Orleans, shall pay for such basic license a fee of six Page 3 of 7 CODING: Words in struck through type are deletions from existing law; words underscored are additions. The 2 license shall expire on the anniversary of the birthday of the applicant which is 3 nearest to a date of six years subsequent to the issuing of the license, unless revoked, 4 canceled, or suspended. 5 * * * 6 (dd)(I) Every applicant seventy years of age or older for a Class "D" driver's 7 license, or for the renewal of a Class "D" driver's license, except those bona fide 8 residents of the city of New Orleans, shall pay for such basic license a fee of twenty- 9 two twenty-three dollars and thirteen cents, which shall be the cost of the license. 10 The license shall expire on the anniversary of the birthday of the applicant which is 11 nearest to the date of six years subsequent to the issuing issuance of the license, 12 unless revoked, canceled, or suspended. 13 * * * 14 (ii)(aa) Every applicant seventy years of age or older for a Class "E" driver's 15 license, or for the renewal of a Class "E" driver's license, issued to bona fide 16 residents of the city of New Orleans, shall pay for such basic license a fee of six 17 seven dollars and seventy-five cents, which shall be the cost of the license. R.S. 46:122(A)(1) is hereby amended and reenacted to read as follows: 4 §122. Louisiana Military Family Assistance Fund 5 A.(1) Funds received by the state treasurer pursuant to the provisions of R.S. 6 47:120.31 and 306.3, or received by the treasurer or the Louisiana Military Family 7 Assistance Board from other public or private donations, gifts, grants, appropriations 8 or other revenue, including revenue derived from the Support Our Troops special 9 prestige license plate as provided for in R.S. 42:463.131 and drivers' license fees as 10 provided for in R.S. 32:412, shall be deposited and credited to a special fund hereby 11 created in the state treasury to be known as the Louisiana Military Family Assistance 12 Fund. The money in the fund shall be used solely as provided for in Subsection B 13 of this Section. In addition to funds from any other source, public or private 14 donations, gifts, or grants from individuals, corporations, nonprofit organizations, 15 or other business entities may be made to the fund and accepted by the fund for 16 military family relief and assistance as provided in this Part. 17 * * * DIGEST The digest printed below was prepared by House Legislative Services.
