HOUSE BILL NO. 546

1	AN ACT
2 To amend and reenact R.S. 40:1135.1(A)(3) and 1135.2(B)(1), relative to emergency
3 medical response vehicles; to provide for qualifications to operate emergency
4 medical response vehicles; to provide for qualifications to operate ambulances; to
5 provide for a written policy; to provide for certain minimum requirements; and to
6 provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 40:1135.1(A)(3) and 1135.2(B)(1) are hereby amended and reenacted
9 to read as follows: 
10 §1135.1.  Qualifications to operate ambulances; equipment; penalty
11	A.

13	(3)(a) The Louisiana Department of Health shall promulgate rules and
14 regulations establishing a list of required medical and safety equipment which shall
15 be carried as part of the regular equipment of every ambulance.  No person shall
16 conduct, maintain, or operate an ambulance which does not carry with it, in fully
17 operational condition, all of the equipment included in the list, which shall be
18 consistent with the scope of practice for emergency medical technicians established
19 in R.S. 40:1133.14.  Each ambulance service provider shall develop and maintain a
20 written policy identifying the equipment required to comply with the provisions of
21 this Paragraph.  At a minimum, the policy shall identify the basic trauma equipment,

1 drugs, suction and oxygen equipment, cardiopulmonary resuscitation equipment, and
2 any other equipment required by law that shall be maintained on the ambulance.
3	(b)  After its initial establishment, the list shall be subject to review after four
4 years and at any time thereafter.  The list shall not be changed more often than once
5 every four years.  However, nothing in this Paragraph shall prohibit the department
6 from supplementing the list with state-of-the-art, newly developed devices,
7 equipment, or medications that may be carried in lieu of other items on the list.

12	B.  No person shall conduct, maintain, or operate an emergency medical
13 response vehicle as an emergency vehicle which:
14	(1)  Does not carry with it as part of its regular equipment the list of
15 equipment, in fully operational condition, for emergency medical response vehicles
16 as prescribed in rules and regulations promulgated by the Louisiana Department of
17 Health. This list shall be based upon the recommendations of the American College
18 of Surgeons as provided in R.S. 40:1135.1(A)(3). The list shall be consistent with the
19 scope of practice for emergency medical technicians established in R.S. 40:1133.14.
20 After initial promulgation, such list shall be subject to review after four years and
21 anytime thereafter. The list shall not be changed more often than once every four
22 years. However, nothing shall preclude the Louisiana Department of Health from
23 supplementing the list with state of the art, newly developed devices, equipment, or
24 medications that may be carried in lieu of other items on the list of equipment.  Each
