ENROLLED 2018 Regular Session HOUSE BILL NO. 711 BY REPRESENTATIVE JAMES AND SENATOR BISHOP 1 AN ACT 2 To amend and reenact R.S. 36:4(X), the title of Chapter 18 of Title 49 of the Louisiana 3 Revised Statutes of 1950, and R.S. 49:1211(E), 1212(A), (B), (C), (D), (E), and (K) 4 and 1213(B), relative to the Louisiana Council on the Social Status of Black Men 5 and Boys; to change the name of the council; to move the council from the office of 6 the lieutenant governor to the office of the governor; to provide relative to the 7 membership and meetings of the council; to provide relative to the council's annual 8 report; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 36:4(X) is hereby amended and reenacted to read as follows: 11 §4. Structure of executive branch of state government 12 * * * 13 X. The Louisiana Council on the Social Status Success of Black Men and 14 Boys, as provided for in R.S. 49:1211 et seq., shall be placed within the office of the 15 lieutenant governor and shall exercise its powers, duties, and functions as provided 16 by law. 17 * * * 18 Section 2. HB NO. 711 ENROLLED 1 CHAPTER 18. LOUISIANA COUNCIL ON THE SOCIAL STATUS SUCCESS 2 OF BLACK MEN AND BOYS 3 §1211. Legislative findings 4 * * * 5 E. With the goal of helping black men and boys to reach their full potential, 6 the Louisiana Legislature hereby enacts the Louisiana Council on the Social Status 7 Success of Black Men and Boys to be the leading entity that provides and promotes 8 an environment that is conducive to productivity, success, and excellence for all 9 black men and boys in the state of Louisiana. 10 §1212. Louisiana Council on the Social Status Success of Black Men and Boys; 11 creation; domicile; membership 12 A. The Louisiana Council on the Social Status Success of Black Men and 13 Boys, hereinafter referred to in this Chapter as the "council", is hereby established 14 in the executive branch of state government in the office of the lieutenant governor. 15 The council is hereby declared to be a body corporate and public, exercising public 16 and essential governmental functions. The domicile of the council shall be in the 17 city of Baton Rouge. 18 B. The council shall be comprised of nineteen twenty-one members as 19 provided in this Subsection and Subsection C of this Section: 20 (1) Two members of the Senate appointed by the president of the Senate. 21 (2) Two members of the House of Representatives appointed by the speaker 22 of the House of Representatives. 23 (3)(a) A representative of a religious community appointed by the chairman 24 of the House Committee on House and Governmental Affairs. 25 (b) A representative of a religious community appointed by the chairman of 26 the Senate Committee on Senate and Governmental Affairs. Two members of 27 religious communities appointed by the governor. 28 (4) The assistant secretary of the office of behavioral health within the 29 Louisiana Department of Health or his designee. HB NO. 711 ENROLLED 1 (5) A representative of the Louisiana Department of Children and Family 2 Services who has expertise in the needs of children appointed by the secretary of the 3 department. 4 (6) The state superintendent of education or his designee who has expertise 5 in early childhood education. 6 (7) A representative of the Louisiana Department of Public Safety and 7 Corrections who has expertise in reentry or recidivism appointed by the secretary of 8 the department. 9 (8) The lieutenant governor or his designee. 10 (9) The secretary of the Louisiana Workforce Commission or his designee. 11 (10) The chairman of the Juvenile Justice Commission. 12 (11) The deputy secretary for the office of juvenile justice, or his designee. 13 (11) Three representatives from community organizations or foundations 14 appointed by the governor. 15 C. The lieutenant governor shall appoint five members as provided for in this 16 Subsection. The presidents of Southern University and Agricultural and Mechanical 17 College, Grambling State University, Dillard University, Xavier University, and 18 Louisiana State University and Agricultural and Mechanical College shall each 19 submit to the lieutenant governor a list of three nominees. The lieutenant governor 20 shall appoint one member from the list of nominees submitted by the president of 21 each academic institution. 22 D. Ten Twelve members shall constitute a quorum, and all actions of the 23 council shall require the affirmative vote of at least ten members. 24 E. The lieutenant governor shall appoint the chairman of the council, and the 25 council shall annually elect a vice chairman from among its members. 26 * * * 27 K. The lieutenant governor shall provide staff and administrative support to 28 the council. The council shall issue its first annual report by February 1, 2009 2019, 4 and by January first fifteenth each following year, stating the findings, conclusions, 5 and recommendations of the council. The council shall submit the report to the 6 governor, lieutenant governor, the president of the Senate, the speaker of the House 7 of Representatives, and the chairmen of the committees with appropriate jurisdiction 8 in the House and Senate.
