RÉSUMÉ DIGEST ACT 276 (HB 747) 2018 Regular Session Emerson Prior law prohibited a marriage officiant from performing a marriage ceremony until 72 hours had elapsed since the issuance of the marriage license. Existing law authorizes a judge, justice of the peace, or retired justice of the peace to waive the delay. Existing law authorizes any officiant authorized to perform marriage ceremonies in the parish of Orleans to waive the delay for nonresident parties upon application of the parties. Existing law provides a penalty of revocation of a marriage officiant's authority, other than a judge or justice of the peace or an officiant authorized to perform ceremonies in Orleans Parish, to perform marriage ceremonies for up to one year for who violates the provisions of existing law. New law changes the 72-hour delay to a 24-hour delay and otherwise retains existing law. Effective August 1, 2018. (Amends R.S. 9:241-243)
