HOUSE BILL NO. 755

1	AN ACT
2 To amend and reenact R.S. 17:154(A) and to enact R.S. 17:436.1(M), relative to elementary
3 and secondary schools; to provide that instruction on substance abuse prevention
4 include certain information about opioids; to authorize the governing authority of
5 each public and nonpublic school to adopt a policy relative to the supply and
6 administration of opioid antagonists; to provide that such a policy require training
7 relative to such administration; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 17:154(A) is hereby amended and reenacted to read as follows:
10 §154.  Curriculum; length of school periods
11	A.(1)  The branches of spelling, reading, writing, drawing, arithmetic,
12 geography, grammar, United States history, and health, including alcohol, tobacco,
13 drug, and substance abuse prevention and education, shall be taught in every
14 elementary school.  In addition to these, such other branches shall be taught as the
15 state board of education, or the provisions of the state constitution, may require.
16	(2)  Every secondary school shall provide instruction in alcohol, tobacco,
17 drug, and substance abuse prevention and education.
18	(3) Any instruction relative to alcohol, tobacco, drug, and substance abuse
19 prevention and education provided pursuant to Paragraphs (1) and (2) of this
20 Subsection shall include the information that mixing opioids and alcohol can cause
21 accidental death.

1 Section 2.  R.S. 17:436.1(M) is hereby enacted to read as follows:
2 §436.1.  Administration of medication; definition; conditions; restrictions;
3	exceptions

5	M.  The governing authority of each public and nonpublic elementary and
6 secondary school may adopt a policy that authorizes a school to maintain a supply
7 of naloxone or other opioid antagonists and authorizes a school nurse or other school
8 employee to administer naloxone or another opioid antagonist to any student or other
9 person on school grounds in the event of an actual or perceived opioid emergency.
10 Such a policy shall require that school employees other than school nurses receive
11 at least six hours of general training, including training on emergency administration,
12 from a registered nurse or a licensed medical physician prior to being authorized to
13 perform such administration.  A school governing authority that does not adopt such
14 a policy shall not be subject to civil liability for failing to authorize such supply or
15 administration.
