HOUSE BILL NO. 766

HEALTH/BEHAVIORAL:  Provides for access to behavioral health services providers in
schools
1	AN ACT
2To enact R.S. 17:173 and 3996(B)(45), relative to behavioral health services for students;
3 to provide relative to behavioral health services provided to students when requested
4 by the student's parent or legal guardian; to provide for definitions; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:173 and 3996(B)(45) are hereby enacted to read as follows: 
8 §173.  Behavioral health services for students
9	A.  A public school governing authority shall not prohibit a behavioral health
10 provider from providing behavioral health services to a student at school during
11 school hours if the student's parent or legal guardian requests such services from the
12 provider.
13	B.  For purposes of this Section, the following terms shall have the following
14 meanings:
15	(1)  "Behavioral health provider" shall mean a provider who is independently
16 licensed or provisionally licensed to provide behavioral health services in Louisiana
17 including but not limited to a psychiatrist, psychologist, counselor, or social worker.
18	(2)  "Behavioral health services" shall include but not be limited to individual

1 psychotherapy, family psychotherapy, psychotropic medication management,
2 community psychiatric support and treatment, and crisis intervention.

4 §3996.  Charter schools; exemptions; requirements
5	*          *          *
6	B.  Notwithstanding any state law, rule, or regulation to the contrary and
7 except as may be otherwise specifically provided for in an approved charter, a
8 charter school established and operated in accordance with the provisions of this
9 Chapter and its approved charter and the school's officers and employees shall be
10 exempt from all statutory mandates or other statutory requirements that are
11 applicable to public schools and to public school officers and employees except for
12 the following laws otherwise applicable to public schools with the same grades:
