HOUSE BILL NO. 777

MTR VEHICLE/LICEN PLATES:  Provides for the "Seymore D'Fair Foundation One
Hundred Percent Me Drug Free" specialty license plate
1	AN ACT
2To enact R.S. 47:463.196, relative to motor vehicle special prestige license plates; to
3 establish the "Seymore D'Fair Foundation One Hundred Percent Me Drug Free"
4 special prestige plate; to provide for creation, issuance, design, fees, distribution, and
5 rule promulgation applicable to such license plates; and to provide for related
6 matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 47:463.196 is hereby enacted to read as follows:
9 ยง463.196.  Special prestige license plate; "Seymore D'Fair Foundation One Hundred
10	Percent Me Drug Free"
11	A.  The secretary of the Department of Public Safety and Corrections shall
12 establish a special prestige motor vehicle license plate to be known as the "Seymore
13 D'Fair Foundation One Hundred Percent Me Drug Free" plate, provided there is a
14 minimum of one thousand applicants for such plate.  The plate shall be restricted to
15 use on passenger cars, pickup trucks, recreational vehicles, motorcycles, and vans.
16	B.  The secretary shall work in conjunction with the Seymore D'Fair
17 Foundation to select the color and design of the plate, provided it is in compliance
18 with R.S. 47:463(A)(3).  The design shall include the words "Seymore D'Fair
19 Foundation One Hundred Percent Me Drug Free".

1	C.  The special prestige license plate shall be issued, upon application, to any
2 citizen of Louisiana in the same manner as any other motor vehicle license plate.
3	D.  The department shall collect an annual royalty fee of twenty-five dollars
4 that shall be disbursed in accordance with Subsection E of this Section.  This fee
5 shall be in addition to the standard motor vehicle license tax imposed by Article VII,
6 Section 5 of the Constitution of Louisiana, and a handling fee of three dollars and
7 fifty cents for each plate to be retained by the department to offset a portion of
8 administrative costs.
9	E.  The annual royalty fee shall be collected by the department and forwarded
10 to the Seymore D'Fair Foundation.  The monies received from the royalty fees shall
11 be dedicated to drug prevention education in elementary and middle schools in the
12 state of Louisiana.
13	F.  The secretary shall promulgate and adopt rules and regulations as are
14 necessary to implement the provisions of this Section.

Abstract:  Creates the "Seymore D'Fair Foundation One Hundred Percent Me Drug Free"
special prestige license plate.  Provides for fees, distribution of fees, issuance,
creation, and design of the license plate and the promulgation of rules.
Proposed law requires the secretary of the Dept. of Public Safety and Corrections to issue
special prestige license plates to be known as the "Seymore D'Fair Foundation One Hundred
Percent Me Drug Free" license plate, provided there is a minimum of 1,000 applicants for
such plate.
Proposed law requires the secretary work in conjunction with the Seymore D'Fair
Foundation to select the color and design of the plate.  Requires the design include the words
"Seymore D'Fair Foundation One Hundred Percent Me Drug Free".

Proposed law requires the department to collect a handling fee of $3.50 for each plate, to be
retained by the department to offset a portion of the administrative costs.
Proposed law requires the secretary to promulgate and adopt rules and regulations to
implement the provisions provided in proposed law.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Transportation,
Highways and Public Works to the original bill:
1. Provide for an annual royalty fee of $25 to be collected by the department and
forwarded to the Seymore D'Fair Foundation to be dedicated by the foundation
to drug prevention education in elementary and middle schools in the state of
Louisiana.
