HOUSE BILL NO. 865

FIRE PROTECT/FIRE MARSHAL: Provides for electronic access of information of the
office of the state fire marshal to certain entities
1 AN ACT
2To enact R.S. 44:3.2(G), relative to the state fire marshal; to require the office of state fire
3 marshal to provide electronic access to its information system to certain entities; to
4 prohibit entities from granting third parties access to documents obtained from the
5 office of state fire marshal; to provide that the office of state fire marshal not be held
6 responsible if entities release protected documents; and to provide for related
7 matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 44:3.2(G) is hereby enacted to read as follows:

12 G.(1) Notwithstanding any other provision of law to the contrary, the office
13 of state fire marshal shall provide electronic access to its information management
14 system, or any subsequent system thereafter, to the State Board of Architectural
15 Examiners or the Louisiana Professional Engineering and Land Surveying Board, for
16 the examination and reproduction of documents submitted to the office of state fire
17 marshal.
18 (2) The State Board of Architectural Examiners and the Louisiana
19 Professional Engineering and Land Surveying Board shall not allow examination or

1 release of any documents obtained from the office of state fire marshal's information
2 system to the public or other third party, including other state agencies.
3 (3) The office of state fire marshal shall not be held responsible or liable for
4 any release of confidential, proprietary, or trade secret information by the State
5 Board of Architectural Examiners or the Louisiana Professional Engineering and
6 Land Surveying Board.

Professional Engineering and Land Surveying Board from granting access of the documents
or releasing the documents to the public or other third party, including state agencies.
Proposed law provides that the office of state fire marshal shall not be held responsible or
liable for release of confidential, proprietary, or trade secret information by the State Board
of Architectural Examiners or the Louisiana Professional Engineering and Land Surveying
Board.
