HLS 18RS-3978 ORIGINAL 2018 Regular Session HOUSE RESOLUTION NO. 184 BY REPRESENTATIVE AMEDEE ECONOMIC DEVELOPMENT: Requests the Department of Economic Development to study and report on commercial activities by state-owned companies or organizations in and subsidized by certain foreign governments and requests the state treasurer to certify that no public funds are used to support commercial activities in foreign governments 1 A RESOLUTION 2To urge and request the Department of Economic Development to study predatory 3 investments and other unfair trade practices in Louisiana by state-owned companies 4 or organizations based in and subsidized by communist countries and submit a report 5 of its findings, to urge and request the state treasurer to certify that no state funds 6 have been used to support state-owned companies or organizations based in 7 communist countries and submit a report verifying that the certification was 8 performed and including any findings he deems relevant, and to request that both 9 reports be submitted to the House of Representatives of the Legislature of Louisiana 10 not later than sixty days prior to the convening of the 2019 Regular Session of the 11 Legislature of Louisiana. 12 WHEREAS, private ownership of capital, free movement of labor, and respect for 13fundamental human rights are foundations upon which the American economy and the 14economy of Louisiana are based; and 15 WHEREAS, many of the laws and institutions developed since World War II do not 16adequately protect against the threats posed to the global economy, the economy of the 17United States, and the economy of Louisiana by the forms of "state capitalism" practiced by 18the People's Republic of China and other communist countries; and Page 1 of 3 HLS 18RS-3978 ORIGINAL HR NO. 184 1 WHEREAS, predatory investments, the theft of intellectual property, and unfair trade 2practices committed by companies and organizations that are subsidized by the governments 3of China and other communist countries cause or threaten to cause harm to companies and 4industries in the United States and the state of Louisiana including but not limited to the 5state's shellfish and chemical industries; and 6 WHEREAS, the government of the state of Louisiana provides public funds to 7encourage investment by companies and organizations in Louisiana, and such investments 8affect Louisiana's existing industries, its workers, and its economic system of free enterprise. 9 THEREFORE, BE IT RESOLVED that the House of Representatives of the 10Legislature of Louisiana does hereby urge and request the Department of Economic 11Development to study investments and other commercial activities by state-owned 12companies or organizations based in and subsidized by a communist country that are doing 13business in Louisiana, particularly as they relate to the impact such investments and 14commercial activities have on existing industries, worker safety, employment, the protection 15of intellectual property, and competition in the state of Louisiana. 16 BE IT FURTHER RESOLVED that the Department of Economic Development shall 17submit a written report of its findings to the House of Representatives of the Legislature of 18Louisiana by not later than sixty days prior to the convening of the 2019 Regular Session of 19the Legislature. 20 BE IT FURTHER RESOLVED that the House of Representatives of the Legislature 21of Louisiana does hereby urge and request the state treasurer to certify that no public funds 22have been used whether through incentives, abatements, or any other means to support 23commercial activities, including investments, by companies or organizations that are owned 24in whole or in part by a foreign government that is identified as a communist government 25by the World Factbook of the United States Central Intelligence Agency. 26 BE IT FURTHER RESOLVED that the state treasurer shall submit a written report 27verifying that the requested certification was performed, along with any findings he deems 28relevant, to the House of Representatives of the Legislature of Louisiana by not later than 29sixty days prior to the convening of the 2019 Regular Session of the Legislature.
