SENATE BILL NO. 119

TAX/TAXATION.  Provides relative to confidentiality of certain taxpayer information
concerning Medicaid eligibility. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 47:1508(B)(33), relative to the confidentiality of taxpayer
3 information; to authorize the disclosure of taxpayer information to the Department
4 of Health to verify eligibility for Medicaid; to provide for an effective date; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 47:1508(B)(33) is hereby amended and reenacted to read as follows: 
8 ยง1508. Confidentiality of tax records

10	B. Nothing herein contained shall be construed to prevent:

12	(33) The sharing or furnishing, in the discretion of the secretary, of
13 information to the Louisiana Department of Health's tax filing unit and Medicaid
14 fraud units for the purposes of complying with mandatory requirements in
15 accordance with federal law, including information necessary to verify an
16 individual's eligibility for Medicaid.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.

Present law authorizes the secretary of the Department of Revenue to furnish taxpayer
information to the Department of Health's tax filing unit for the purposes of complying with
federal law.
Proposed law authorizes the secretary of the Department of Revenue to also furnish taxpayer
information to the Department of Health's Medicaid fraud unit as necessary for the purposes
of verification of eligibility for Medicaid.
Effective upon the signature of the governor or lapse of time for gubernatorial action.
