SENATE BILL NO. 120

SHERIFFS.  Provides relative to premium costs for retired sheriffs and deputy sheriffs of
the Vermilion Parish Sheriff's Office. (7/1/18)
1	AN ACT
2 To amend and reenact R.S. 13:5554(G)(1) and to enact R.S. 13:5554(II), relative to payment
3 of certain premium costs of retired sheriffs and retired deputy sheriffs; to provide
4 relative to payment of certain premium costs for retired sheriffs and retired deputy
5 sheriffs of the Vermilion Parish Sheriff's Office; to provide for eligibility for
6 payment of premium costs; to provide for applicability; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 13:5554(G)(1) is hereby amended and reenacted and R.S. 13:5554(II)
10 is hereby enacted to read as follows:
11 ยง5554. Group insurance; kinds; amounts; subrogation

13	G.(1) Notwithstanding the provisions of Subsection D of this Section, the
14 premium costs of group hospital, surgical, medical expense, and dental insurance and
15 the first ten thousand dollars of life insurance contracted for under the provisions of
16 this Section shall be paid in full from the sheriff's general fund for all sheriffs and
17 deputy sheriffs retired with at least fifteen years of service who are at least fifty-five

1 years of age or retired with at least thirty years of service at any age. The provisions
2 of this Subsection shall be applicable only to the sheriffs' offices of the parishes of
3 Bossier, St. Bernard, St. Martin, Acadia, Allen, Avoyelles, Beauregard, Caddo,
4 Calcasieu, Caldwell, Cameron, Catahoula, Concordia, East Feliciana, Grant,
5 Iberville, Jackson, Jefferson Davis, Lafayette, Lincoln, Livingston, Morehouse,
6 Natchitoches, Pointe Coupee, Rapides, Red River, St. James, Tangipahoa, Union,
7 Vermilion, Vernon, Washington, West Baton Rouge, West Carroll, and West
8 Feliciana and the sheriff of the Civil District Court of the parish of Orleans, for their
9 respective retirees. The provisions of this Subsection shall also apply to the
10 employees of the Sheriffs' Pension and Relief Fund and the Louisiana Sheriffs'
11 Association, which fund and association shall pay the premium costs for their
12 employees.

14	II. (1) Notwithstanding the provisions of Subsection D of this Section, for
15 persons hired on or before June 30, 2018, and retire on or after July 1, 2018, the
16 Vermilion Parish Sheriff's Office shall pay the premium costs of group hospital,
17 surgical, medical expense, and dental insurance and the first ten thousand
18 dollars of life insurance out of the sheriff's general fund for all sheriffs and
19 deputy sheriffs who retire with at least fifteen years of full-time continuous and
20 creditable service with the Vermilion Parish Sheriff's Office and are at least
21 fifty-five years of age or who retire with at least thirty years of full-time
22 continuous and creditable service with the Vermilion Parish Sheriff's Office,
23 regardless of age.
24	(2) For any sheriff or deputy sheriff hired on or after July 1, 2018, the
25 sheriff of Vermilion Parish shall pay out of the sheriff's general fund the
26 premium costs of group insurance for any retired sheriff and any retired deputy
27 sheriff who retires from the Vermilion Parish Sheriff's Office as follows:
28	(a) Fifty percent of the premium costs of group hospital, surgical, dental,
29 and medical expense and the first ten thousand dollars of life insurance if the

1 sheriff or deputy sheriff has at least fifteen years of full-time continuous and
2 creditable service with the Vermilion Parish Sheriff's Office and is at least fifty-
3 five years of age and is retiring from active service with the Vermilion Parish
4 Sheriff's Office. A sheriff or deputy sheriff's creditable days of full-time service
5 shall be determined by the Louisiana Sheriffs' Pension and Relief Fund.
6	(b) One hundred percent of the premium costs of group hospital,
7 surgical, dental, and medical expense insurance and the first ten thousand
8 dollars of life insurance if the sheriff or deputy sheriff has at least thirty years
9 of full-time continuous and creditable service with the Vermilion Parish
10 Sheriff's Office, regardless of age. A sheriff or deputy sheriff's creditable days
11 of full-time service shall be determined by the Louisiana Sheriffs' Pension and
12 Relief Fund.
13	(3) The Vermilion Parish Sheriff's Office shall not be required to pay the
14 premium costs of group hospital, surgical, medical expense, and dental
15 insurance and the first ten thousand dollars of life insurance for any person who
16 retires on or after July 1, 2018, if such person separates from full-time
17 continuous and creditable service with the Vermilion Parish Sheriff's Office
18 before meeting the requirements of Paragraphs (1) or (2) of this Subsection.
19 Section 2. This Act shall become effective on July 1, 2018.

Present law provides that the sheriff of Vermilion Parish shall pay in full from the sheriff's
general fund certain insurance premium costs for all sheriffs and deputy sheriffs retired with
at least 15 years of service who are at least 55 years of age or retired with at least 30 years
of service at any age.
Proposed law provides that, for persons hired on or before June 30, 2018, and retiring after
July 1, 2018, the 15 or 30 years of service must be with the Vermilion Parish Sheriff's
Department and otherwise retains present law.
Proposed law provides that for persons hired on or after July 1, 2018, the Vermilion Parish
Sheriff shall pay from the general fund premium costs as follows:
(1)50% for retired sheriffs and deputy sheriffs with 15 years of full-time continuous and

creditable service with the Vermilion Parish Sheriff's Office that are 55 years of age
or older and retiring from active service.
(2)100% for retired sheriffs and deputy sheriffs with 30 years of full-time continuous
and creditable service with the Vermilion Parish Sheriff's Office, regardless of age. 
Proposed law provides that the Vermilion Parish Sheriff's Office shall not be required to pay
the premium costs for any person who retires on or after July 1, 2018, if such person
separates from full-time continuos and creditable service with the Vermilion Parish Sheriff's
Office before meeting the requirements of proposed law.
Effective July 1, 2018.
