SENATE BILL NO. 124

SHERIFFS.  Allows the sheriff's offices of Acadia, Lafayette, and Vermilion parishes to
issue warning citations. (8/1/18)
1	AN ACT
2 To amend and reenact R.S. 32:398.1(C), relative to traffic citations; to provide for warning
3 citations; to allow warning citations in Acadia, Lafayette, and Vermilion parishes;
4 and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 32:398.1(C) is hereby amended and reenacted to read as follows:
7 ยง398.1. Traffic citations; form; issuance

9	C. The Except for the sheriff's offices of Acadia, Lafayette, and
10 Vermilion parishes, the issuance of warning citations for violations of the motor
11 vehicle laws of this state is hereby specifically prohibited. However, nothing herein
12 shall prohibit a peace officer from issuing a violation ticket which compels or
13 instructs the motorist to comply with administrative or other legal requirements of
14 Title 32 or Title 47 of the Louisiana Revised Statutes of 1950.

Present law prohibits the issuance of warning citations for violations of motor vehicle laws.
Proposed law exempts the sheriff's offices of Acadia, Lafayette, and Vermilion parishes and
allows the issuance of warning citations in those parishes.
Present law allows peace officers in all parishes to issue a violation ticket that compels or
instructs the motorist to comply with administrative or other legal requirements.
Proposed law retains present law.
Effective August 1, 2018.
