2018 Regular Session ENROLLED SENATE BILL NO. 133 BY SENATORS HEWITT AND BARROW 1 AN ACT 2 To enact R.S. 44:3.2(G), relative to public records; to provide an exception for access to 3 proprietary and trade secrets in the custody or control of the office of state fire 4 marshal; to provide access to state fire marshal documents by certain entities; and to 5 provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 44:3.2(G) is hereby enacted to read as follows: 8 §3.2. Proprietary and trade secret information 9 * * * 10 G. Notwithstanding any other provision of law to the contrary, the office 11 of state fire marshal shall provide electronic access to its information 12 management system to the State Board of Architectural Examiners and the 13 Louisiana Professional Engineering and Land Surveying Board for the 14 examination and reproduction of plans, drawings, and specifications submitted 15 to the office of state fire marshal. The State Board of Architectural Examiners 16 and the Louisiana Professional Engineering and Land Surveying Board shall 17 not allow for examination or release of any documents obtained from the office 18 of state fire marshal’s information system to the public or other third party, 19 including other state agencies. The office of state fire marshal shall not be held 20 responsible or liable for any release of confidential, proprietary, or trade secret 21 information by the State Board of Architectural Examiners or the Louisiana 22 Professional Engineering and Land Surveying Board.
