LAW ENFORCEMENT.  Adds to public employees required to meet peace officer training
requirements, local personnel with limited authority for enforcement of a local sanitation
standard code. (8/1/18)
1	AN ACT
2 To enact R.S. 40:2402(3)(e), relative to Peace Officer Standards and Training Law; to
3 include personnel whose duties include enforcement of a local sanitation standards
4 code within the definition of "peace officer"; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:2402(3)(e) is hereby enacted to read as follows:
7 ยง2402. Definitions
8 As used in this Chapter:

11	(e) "Peace officer" shall also include personnel of local government
12 whose duties include enforcement of a local sanitation standards code and who
13 has limited authority to issue summons for violations of the sanitation standard
14 code.

Present law provides minimum training standards for any person who is employed as a peace
officer in Louisiana.
Present law defines "peace officer" as any employee of the state, a municipality, a sheriff,
or other public agency, whose permanent duties actually include the making of arrests, the
performing of searches and seizures, or the execution of criminal warrants, and is
responsible for the prevention or detection of crime or for the enforcement of the penal,
traffic, or highway laws of this state, but not including any elected or appointed head of a
law enforcement department.
Present law also defines "peace officer" as a sheriff's deputy whose duties include the care,
custody, and control of inmates.
Present law also defines "peace officer" as military police officers within the La. Military
Dept.
Present law also defines "peace officer" as security personnel employed by the La. Supreme
Court.
Proposed law retains present law and also defines "peace officer" as personnel of local
government whose duties include enforcement of a local sanitation standard code and has
limited authority to issue summons for violations of the sanitation standard code.
Effective August 1, 2018.
