TRAFFIC.  Provides relative to speed cameras. (8/1/18)
1	AN ACT
2 To amend and reenact R.S. 32:45(A) and (C), relative to speed cameras; to provide that a
3 speed camera produces a recorded image of a motor vehicle traveling at a speed at
4 least nine miles above the posted speed limit; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 45(A) and (C) are hereby amended and reenacted to read as follows:
7 ยง45. Required notification for mobile a speed camera
8	A. Local municipal authorities or local parish authorities shall post signs
9 indicating that a mobile speed camera is present. The sign shall be posted no less
10 than two hundred fifty feet and no more than five hundred feet of the location of each
11 mobile speed camera in such a manner as to be clearly visible, not obstructed by any
12 barrier, equipment, vegetation, or other object, and shall be easily viewable by
13 drivers approaching the speed camera. The sign shall comply with the current
14 manual and specifications adopted by the Department of Transportation and
15 Development pursuant to R.S. 32:235.

17	C. For the purposes of this Section, "mobile speed camera" means a device

1 designed to collect photographic or video evidence of an alleged violation of a
2 posted speed limit by recording images that depict the license plate or other
3 identifying feature of a motor vehicle that is not operated in compliance with a
4 posted speed limit sign with one or more motor vehicle sensors producing
5 recorded images depicting the license plate or other identifying features of
6 motor vehicles traveling at speeds at least nine miles per hour above the posted
7 speed limit.

Present law requires local municipal or parish governing authorities to post signs indicating
that a mobile speed camera is present. Requires posting the sign no less than 250 feet and
no more than 500 feet from the location of each speed camera. Requires that the sign be
posted in a manner to be clearly visible to traffic approaching the speed camera. Requires
that the sign comply with the current manual and specifications adopted by DOTD pursuant
to R.S. 32:235.
Proposed law changes term "mobile speed camera" to "speed camera".
Present law defines a "mobile speed camera" as a device designed to collect photographic
or video evidence of alleged speed limit violation by recording images that depict the license
plate or other identifying features of a motor vehicle being operated out of compliance with
instruction of a posted speed limit sign.
Proposed law defines "a speed camera" as a device designed to collect photographic or video
evidence with one or more motor vehicle sensors producing recorded images depicting the
license plate or other identifying features of motor vehicles traveling at speeds at least nine
miles per hour above the posted speed limit.
