SENATE BILL NO. 170

1 AN ACT
2 To amend and reenact the introductory paragraph of R.S. 3:1382(A) and to enact R.S.
3 3:1382(A)(8) and (9), relative to the Agricultural Chemistry and Seed Commission;
4 to increase the commission membership; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. The introductory paragraph of R.S. 3:1382(A) is hereby amended and
7 reenacted and R.S. 3:1382(A)(8) and (9) are hereby enacted to read as follows:
8 ยง1382. Commission; creation
9 A. There is hereby created, within the Department of Agriculture and
10 Forestry, the Louisiana Agricultural Chemistry and Seed Commission. The
11 commission shall consist of seven nine members as follows:

13 (8) One member actively engaged in farming appointed by the chairman
14 of the House Agriculture, Forestry, Aquaculture, and Rural Development
15 Committee.
16 (9) One member actively engaged in farming appointed by the chairman
17 of the Senate Agriculture, Forestry, Aquaculture, and Rural Development

3 Section 2. This Act shall become effective upon signature by the governor or, if not
4 signed by the governor, upon expiration of the time for bills to become law without signature
5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
6 vetoed by the governor and subsequently approved by the legislature, this Act shall become
7 effective on the day following such approval.

Present law creates the Louisiana Agricultural Chemistry and Seed Commission within the
Department of Agriculture and Forestry, consisting of seven members as follows:
(1)The commissioner of agriculture and forestry or his designee.
(2)One member and an alternate, representing the Louisiana Agricultural Experiment
Station, appointed by the commissioner and serving at the pleasure of the
commissioner.
(3) One member and an alternate, representing the Louisiana Cooperative Extension
Service, appointed by the commissioner and serving at the pleasure of the
commissioner.
(4)The president of Louisiana Farm Bureau Federation, Inc. or his designee, subject to
the approval of the commissioner.
(5)One member representing the seed industry appointed by the commissioner from a
list of three nominees submitted by the Louisiana Ag Industries Association and
serving at the pleasure of the commissioner.
(6)One member representing the fertilizer industry appointed by the commissioner from
a list of three nominees submitted by the Louisiana Ag Industries Association and
serving at the pleasure of the commissioner.
(7)One member representing the feed industry appointed by the commissioner from a
list of three nominees submitted by the Louisiana Ag Industries Association and a
list of three nominees submitted by the Louisiana Cattlemen's Association and
serving at the pleasure of the commissioner.
Proposed law increases the membership of the commission from seven to nine.
Proposed law adds one member to the commission who is actively engaged in farming
appointed by the chairman of the House Agriculture, Forestry, Aquaculture and Rural
Development Committee.
