(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 48:262(A), relative to the Department of Transportation and 3 Development; to authorize the department to purchase, rent, or lease maintenance 4 equipment; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 48:262(A) is hereby amended and reenacted to read as follows: 7 ยง262. Maintenance equipment owned by or temporarily leased to the; purchase, 8 rent, or lease by the department; rent or lease to others 9 A. When the secretary determines that it is necessary or economically 10 feasible to use specialized maintenance equipment which will not be needed on a 11 permanent basis, the The department may purchase, rent, or lease, in accordance 12 with the provisions of the public bid law, such equipment for the shortest period 13 required under the circumstances. DIGEST SB 212 Original 2018 Regular Session Gatti Present law allows DOTD to lease specialized maintenance equipment which will not be needed on a permanent basis for the shortest period required under the circumstances, in accordance with the public bid law, when the secretary determines that it is necessary or economically feasible. Present law, in all other cases, requires the DOTD to own the fixed and mobile equipment necessary to appropriately maintain and operate the facilities under its jurisdiction. Present law does not require the DOTD to accept equipment offered at the lowest price when purchasing equipment when such practice would result in the ownership or use of so many different types or brands that economic operation and maintenance of the equipment would be impracticable. Proposed law changes present law to authorize DOTD to purchase, rent, or lease fixed and mobile equipment necessary to appropriately maintain and operate its facilities. Effective August 1, 2018.
