SENATE BILL NO. 284

HEALTH CARE.  Provides relative to the Disaster and Emergency Medical Services
Committee of the Louisiana State Medical Society.  (gov sig)
1	AN ACT
2 To amend and reenact R.S. 40:1133.14(E) and (F), relative to emergency medical services
3 protocols; to repeal provisions regarding the Disaster and Emergency Medical
4 Services Committee of the Louisiana State Medical Society; and to provide for
5 related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1133.14(E) and (F) are hereby amended and reenacted to read as
8 follows:
9 ยง1133.14. Duties of emergency medical personnel
10	A.(1) A licensed emergency medical services practitioner may perform any
11 of the following functions:

13	E. In the event that there is no organized or functional local parish medical
14 society in a parish of the state, the provisions of this Section which require the
15 approval of an emergency medical service protocol by the local parish medical
16 society or its designee may be performed by a parish or multiparish medical society
17 which is adjacent or contiguous to the parish without an organized or functional local

1 parish medical society. In the absence of such adjacent or contiguous parish or
2 multiparish medical society, the district medical society shall approve an emergency
3 medical service protocol for the parish without an organized or functional local
4 parish medical society. In the event the district medical society does not approve an
5 emergency medical service protocol for the parish without an organized or functional
6 local parish medical society, the disaster and emergency medical services committee
7 of the Louisiana State Medical Society shall approve an emergency medical service
8 protocol for the parish without an organized or functional local parish medical
9 society.
10	F. The department shall promulgate rules and regulations establishing basic
11 guidelines for statewide emergency medical service protocols. Such rules and
12 regulations shall be based on the recommendations of the Louisiana State Medical
13 Society's disaster and emergency medical services committee, which shall serve as
14 an advisory committee to the department for this purpose.
15 Section 2.  This Act shall become effective upon signature by the governor or, if not
16 signed by the governor, upon expiration of the time for bills to become law without signature
17 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
18 vetoed by the governor and subsequently approved by the legislature, this Act shall become
19 effective on the day following such approval.

Present law, relative to protocols for licensed emergency medical services practitioners,
provides that in the event that there is no organized or functional local parish medical society
in a parish, present law requires the approval of an emergency medical service protocol be
performed by a parish or multiparish medical society which is adjacent or contiguous to the
parish. Further, in the absence of such adjacent or contiguous parish or multiparish medical
society, the district medical society shall approve an emergency medical service protocol for
the parish. Provides that in the event the district medical society does not approve an
emergency medical service protocol for the parish, the disaster and emergency medical
services committee of the La. State Medical Society shall approve an emergency medical
service protocol for the parish.
Present law requires the Department of Health promulgate rules and regulations establishing

basic guidelines for statewide emergency medical service protocols based on the
recommendations of the La. State Medical Society's disaster and emergency medical
services committee, which serves as an advisory committee to the department for this
purpose.
Proposed law removes references to the La. State Medical Society's disaster and emergency
medical services committee.
Effective upon signature of the governor or lapse of time for gubernatorial action.
