DIGEST SB 310 Reengrossed 2018 Regular Session Claitor Present law requires the state Department of Education (DOE) to establish a standardized data collection and analysis system to collect data from schools and school systems in a range of specified data elements. Present law additionally requires the annual collection and reporting of specified data elements with respect to students with exceptionalities, excluding gifted and talented. Further requires that the data collected be reported for each disability classification in total and by race, gender, age, and sex. Present law requires DOE to annually compile a report that includes the data on each element gathered from the latest collection cycle and trend data from the three prior years. Provides that the report be sent to each public school governing authority and published on the department's website. Proposed law retains present law. Proposed law directs the commissioner of administration to withhold $100,000 of the funds appropriated to the state DOE through the general appropriation bill for "STATE ACTIVITIES" for any fiscal year in which the department fails to collect and report the data in the required manner, until such time as the department complies with present law. Effective upon signature of the governor or lapse of time for gubernatorial action.
