SENATE BILL NO. 344

PUBLIC LANDS.  Authorizes the commissioner of administration to transfer certain state
property in Webster Parish.  (gov sig)
1	AN ACT
2 To authorize and provide for the transfer of certain state property; to authorize the transfer
3 of certain state property in Webster Parish; to provide for the property description;
4 to provide for reservation of mineral rights; to provide terms and conditions; to
5 provide an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The commissioner of administration, notwithstanding any other
8 provision of law to the contrary, is hereby authorized and empowered to convey,
9 transfer, assign, lease, or deliver any interest, excluding mineral rights, the state may
10 have to all or any portion of the following described parcel of property lying below the
11 148.6' contour line per NGVD 29 elevation datum to Gladys Henderson:
12	Begin at a point 1320 feet West of the Southeast corner of said Lot No.
13 3, Section 24, Township 17 North, Range 10 West, Webster Parish, Louisiana,
14 on the South boundary of said Lot No. 3, and from thence run East, along said
15 South boundary, a distance of 1320 feet to the Southeast corner of said Lot No.
16 3; thence run North, along the East boundary of said Lot No. 3, a distance of
17 approximately 2040 feet to the meander line of Lake Bisteneau; thence run

1 South 76 degrees West a distance of 150 feet along the said meander line; thence
2 due South 340 feet; thence South 76 degrees West a distance of 510 feet; thence
3 in a Southwesterly direction, in a straight line, to the point of beginning,
4 containing 40 acres, more or less.
5 Section 2.  The commissioner of administration is hereby authorized to enter
6 into such agreements, covenants, conditions, and stipulations and to execute such
7 documents as necessary to properly effectuate any conveyance, transfer, assignment,
8 lease, or delivery of title, excluding mineral rights, to the property described in
9 Section 1, and as more specifically described in any such agreements entered into and
10 documents executed by and between the commissioner of administration and Gladys
11 Henderson, in exchange of consideration proportionate to at least the appraised value
12 of the property.
13 Section 3.  The proceeds of any sale of all or any portion of the above parcel of
14 property shall be paid into the Aquatic Plant Control Fund and dedicated to aquatic
15 weed control and eradication in Lake Bistineau.
16 Section 4.  This Act shall become effective upon signature by the governor or, if not
17 signed by the governor, upon expiration of the time for bills to become law without signature
18 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
19 vetoed by the governor and subsequently approved by the legislature, this Act shall become
20 effective on the day following such approval.

Committee Amendments Proposed by Senate Committee on Natural Resources to

1. Changes effective date from August 1, 2018, to upon signature of the
governor or lapse of time for gubernatorial action.
