SB 40 Reengrossed 2018 Regular Session	Mills
Proposed law provides for the transfer of healthcare professional licensing agencies, boards,
commissions, and like entities to the La. Department of Health (LDH) and deletes repealed
and obsolete citations and references.
Present law places the La. Board of Veterinary Medicine within LDH.  Proposed law places
the board within the La. Dept. of Agriculture and Forestry.
Present law provides for the membership of and qualifications for healthcare professional
licensing boards.  Proposed law retains present law and adds at least one consumer member
to each healthcare professional licensing board that did not previously have one.  Provides
standardized eligibility criteria for such consumer members.
Proposed law requires the governor to ensure that his appointments to healthcare
professional licensing boards demonstrate diversity with respect to race, gender, ethnicity,
and geography.
Proposed law authorizes all licensing boards and commissions created and provided for in
present law to develop a process to issue a license, permit, or certificate outside the national
examination for those individuals with a disorder which is recognized by the Americans with
Disabilities Act.

Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Health and Welfare to
the original bill
1. Makes technical amendments.
2. Adds a provision requiring the governor to ensure race, gender, ethnic, and
geographical diversity in his appointments to health profession licensing
boards.
3. Increases the number of board members for the Louisiana State Board of
Examiners of Psychologists from five to six.
4. Increases the number of board members for the Louisiana Behavior Analyst
Board from five to seven.
5. Removes the radiological physicist appointee and restores a hospital
administrator appointee to the Louisiana State Radiologic Technology Board
of Examiners.

The Committee Amendments Proposed by House Committee on Health and Welfare to
the reengrossed bill:
1. Delete the entirety of proposed law amending or repealing present law relative
to nomination by professional trade associations of candidates for positions on
boards and commissions that license and regulate healthcare professionals.
2. Provide that any board or commission created and provided for in present law
may develop a process to issue a license, permit, or certificate outside the
national examination for those individuals with a disorder which is recognized
by the Americans with Disabilities Act.
