Provides with respect to the membership of the Coastal Protection and Restoration Authority Board. (gov sig) 1 AN ACT 2 To amend and reenact R.S. 49:214.5.1, relative to the Coastal Protection and Restoration 3 Authority Board; to provide for its membership; and to provide for related matters. 4 Be it enacted by the Legislature of Louisiana: 5 Section 1. R.S. 49:214.5.1 is hereby amended and reenacted to read as follows: 6 ยง214.5.1. Coastal Protection and Restoration Authority Board 7 A. The Coastal Protection and Restoration Authority Board is hereby created 8 within the office of the governor. The board is hereby established, and shall exercise 9 the powers and duties hereinafter set forth or otherwise provided by law. The 10 provisions of R.S. 44:5(A) shall not be applicable to any activities or records of or 11 pertaining to the authority. 12 B. The Coastal Protection and Restoration Authority Board shall consist of 13 the following members: 14 (1) Executive The executive assistant to the governor for coastal activities. 15 (2) Secretary The secretary of the Department of Natural Resources or his 16 designee. 17 (3) Secretary The secretary of the Department of Wildlife and Fisheries or Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 433 SLS 18RS-503 ENGROSSED 1 his designee. 2 (4) Secretary The secretary of the Department of Environmental Quality or 3 his designee. 4 (5) Secretary The secretary of the Department of Transportation and 5 Development or his designee. 6 (6) Secretary The secretary of the Department of Economic Development 7 or his designee. 8 (7) Commissioner The commissioner of administration or his designee. 9 (8) Commissioner The commissioner of agriculture and forestry or his 10 designee. 11 (9) Commissioner The commissioner of insurance or his designee. 12 (10) Seven members who shall be appointed by the governor, in consultation 13 with the Police Jury Association of Louisiana and the Association of Levee Boards 14 of Louisiana, from nominations submitted by the levee districts located in whole or 15 in part in the coastal area, from legislators who represent districts in whole or in part 16 in the coastal area, and from the parish governing authorities located in whole or in 17 part in the coastal area. The appointees shall be residents of the coastal area and shall 18 be appointed on a proportional basis in such a manner as to reflect the population and 19 land area of the parishes located in whole or in part in the coastal area. However, 20 there shall be at least two appointees who reside in the area of the coastal area 21 located west of the Atchafalaya River and at least two appointees who reside in the 22 area of the coastal area located east of the Atchafalaya River. 23 (11) The chair of the Governor's Advisory Commission on Coastal 24 Protection, Restoration, and Conservation or his designee. 25 (12) The director of the Governor's Office of Homeland Security and 26 Emergency Preparedness or his designee. 27 (13) The speaker of the House of Representatives, or his designee, who shall 28 serve as an ex officio member who shall not have the authority to vote and who shall 29 not be counted for purposes of a quorum. SB NO. 433 SLS 18RS-503 ENGROSSED 1 (14) The president of the Senate, or his designee, who shall serve as an ex 2 officio member who shall not have the authority to vote and who shall not be 3 counted for purposes of a quorum. 4 (15) Any member of the board who represents a political subdivision shall 5 recuse himself from deliberations and from voting on any matter concerning the 6 taking of action against that political subdivision for lack of compliance with the 7 plan. 8 C. The executive assistant shall serve as chairman and shall develop 9 procedures for the operation of the board. 10 Section 2. This Act shall become effective upon signature by the governor or, if not 11 signed by the governor, upon expiration of the time for bills to become law without signature 12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 13 vetoed by the governor and subsequently approved by the legislature, this Act shall become 14 effective on the day following such approval.
