(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 4:705(1), (9), and (10)(a) and 706(A) and (B) and to enact R.S. 3 4:705(2)(f) and 707.1, relative to gaming; to authorize public institutions of higher 4 education to conduct raffles to support the institution; to provide for state licensure; 5 to provide for duties and functions of the office of charitable gaming; and to provide 6 for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 4:705(1), (9) and (10)(a) and 706(A) and (B) are hereby amended 9 and reenacted and R.S. 4:705(2)(f), and 707.1 are hereby enacted to read as follows: 10 §705. Office functions, duties, and responsibilities 11 The office shall have the following functions, duties, and responsibilities: 12 (1)(a) To issue and renew annual state licenses required by law for 13 organizations conducting games of chance pursuant to the Charitable Raffles, Bingo 14 and Keno Licensing Law, for manufacturers or distributors of supplies or equipment 15 for such games, and for commercial lessors of premises on which such games are 16 conducted. 17 (b) To issue and renew annual state licenses required by law for public Page 1 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 468 SLS 18RS-1093 ORIGINAL 1 institutions of higher education conducting games of chance pursuant to R.S. 2 4:707.1. 3 (2) To establish, assess, and collect the following fees for issuance of licenses 4 and special licenses and for license renewals as follows: 5 * * * 6 (f) Public institution of higher education's license and renewal fee shall 7 be seventy-five dollars. 8 * * * 9 (9) To familiarize the general public, and in particular members of 10 organizations and public institutions of higher education which conduct charitable 11 games of chance, with provisions of the Charitable Raffles, Bingo and Keno 12 Licensing Law and other applicable laws and regulations. 13 (10)(a) To adopt rules and regulations to provide for the sale or transfer of 14 surplus supplies or equipment from one licensed organization or public institution 15 of higher education to another and such other rules and regulations as are necessary 16 to carry out the purposes and functions of this Chapter strictly in accordance with 17 Subparagraph (b) of this Paragraph. 18 * * * 19 §706. Decision whether to permit raffles, bingo, and keno 20 A. The Except for a public institution of higher education licensed 21 pursuant to R.S. 4:707.1, the governing authority of each such municipality shall 22 decide whether charitable raffles, bingo, and keno as provided for in this Chapter 23 shall be permitted within the limits of the municipality. 24 B. The Except for a public institution of higher education licensed 25 pursuant to R.S. 4:707.1, the governing authority of each parish shall decide 26 whether charitable raffles, bingo, and keno as provided for in this Chapter shall be 27 permitted within the parish. 28 * * * 29 §707.1. SB NO. 468 SLS 18RS-1093 ORIGINAL 1 state license; exemptions 2 A.(1) A public institution of higher education, when licensed as provided 3 in this Section, may hold and operate the game of chance commonly known as 4 raffle or raffles played by drawing for prizes or the allotment of prizes by 5 chance, by the selling of shares, tickets, or rights to participate in the game or 6 games, and by conducting the game or games accordingly. 7 (2) The office may license a public institution of higher education to hold 8 and operate the game of chance commonly known as raffle or raffles played by 9 drawing for prizes or the allotment of prizes by chance, by the selling of shares, 10 tickets, or rights to participate in the game or games, and by conducting the 11 game or games accordingly. 12 B. As used in this Subsection, "public institution of higher education" 13 includes each in-state public graduate and undergraduate institution, public 14 junior and community college, public technical institute, and each separate 15 school or department of the institution, college, or institute. 16 C. A public institution of higher education licensed pursuant to this 17 Section may sell shares, tickets, or rights to participate in the authorized games 18 and may conduct the games accordingly when the entire net proceeds of the 19 games of chance are devoted to supporting the institution. 20 D.(1) No municipal or parish governing authority shall require local 21 licensure of an institution licensed pursuant to this Section. 22 (2) A public institution of higher education licensed pursuant to this 23 Section shall be exempt from the licensing and reporting requirement provided 24 in R.S. 4:708 through 716 for the purpose of conducting a raffle as defined in 25 R.S. 4:707(A)(1). DIGEST SB 468 Original 2018 Regular Session Morrish Present law, relative to charitable raffles, bingo, and gaming, requires that the office of charitable gaming issue and renew annual state licenses required by law for organizations conducting games of chance, for manufacturers or distributors of supplies or equipment for such games, and for commercial lessors of premises on which such games are conducted. Proposed law retains present law and also provides that the office shall issue and renew annual state licenses required by proposed law for public institutions of higher education conducting raffles pursuant to proposed law. Proposed law provides that the office may establish, assess, and collect $75 for issuing or renewing a license for a public institution of higher education to conduct raffles. Present law requires that the office familiarize the general public, and in particular members of organizations which conduct charitable games of chance, with present law and applicable regulations. Proposed law retains present law and includes public institutions of higher education conducting raffles. Present law provides that the office is to adopt rules and regulations as are necessary to carry out the purposes and functions of the Charitable Raffles, Bingo and Gaming Law. Proposed law retains present law. Present law provides that the governing authority of each municipality and parish shall decide whether charitable raffles, bingo, and keno shall be permitted within the limits of the boundaries. Proposed law retains present law but provides that these provisions are not applicable to raffles conducted by a public institution of higher education licensed pursuant to proposed law. Proposed law provides that a public institution of higher education, when licensed as provided in proposed law, may hold and operate a raffle or raffles when the entire net proceeds are devoted to supporting the institution. Provides that the office of charitable gaming may license a public institution of higher education to hold and operate a raffle or raffles. Provides that "public institution of higher education" includes each in-state public graduate and undergraduate institution, public junior and community college, public technical institute, and each separate school or department of the institution, college, or institute. Provides that no municipal or parish governing authority shall require local licensure of an institution licensed pursuant to proposed law. Provides that a public institution of higher education licensed to conduct a raffle shall be exempt from the other licensing and reporting requirements provided in present law. Effective August 1, 2018.
