(8/1/18) 1 AN ACT 2 To amend and reenact the introductory paragraph of R.S. 37:1314(B), the introductory 3 paragraph of (C)(1), (1)(d), (e), (f), (g), and (h), the introductory paragraph of (C)(2), 4 (C)(3), and (D), (E), (F), (G), (H), and (I), to enact R.S. 37:1314 (B)(5), (C)(1)(f)(iii), 5 (i) and (j), and (2)(d), and to repeal R.S. 37:1314(J), relative to the Clinical 6 Laboratory Personnel Committee of the Louisiana State Board of Medical 7 Examiners; to provide for committee membership; to repeal provisions relative to the 8 initial appointment of committee members; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. The introductory paragraph of R.S. 37:1314(B), the introductory 11 paragraph of (C)(1), (1)(d), (e), (f), (g), and (h), the introductory paragraph of (C)(2), (C)(3), 12 and (D), (E), (F), (G), (H), and (I) are hereby amended and reenacted and R.S. 13 37:1314(B)(5), (C)(1)(f)(iii), (i) and (j), and (2)(d) are hereby enacted to read as follows: 14 ยง1314. The board shall 2 appoint four five members of the committee, subject to Senate confirmation, as 3 follows: 4 * * * 5 (5) One university administrator from a Louisiana Community and 6 Technical College appointed from a list of three names submitted by the 7 Louisiana Community and Technical College System. 8 C.(1) The governor shall appoint eight ten members of the committee, 9 subject to Senate confirmation, as follows: 10 * * * 11 (d) One clinical laboratory scientist-generalist, not holding a degree 12 above the associate level. 13 (e) One clinical laboratory scientist-technician. 14 (e)(f) One clinical laboratory scientist-specialist appointed from a list of four 15 six names compiled by the submission of two names from each of the following two 16 three organizations: 17 * * * 18 (iii) The American Association of Bioanalysts, for nomination of a 19 Louisiana member. 20 (f)(g) One clinical laboratory scientist-generalist who is in a supervisory or 21 administrative capacity appointed from a list of three names submitted by the 22 Louisiana Hospital Association. 23 (g)(h) One cytotechnologist appointed from a list of three names submitted 24 by the Clinical Laboratory Personnel Association. 25 (h)(i) One laboratory assistant who shall be a member of the International 26 Society for Clinical Laboratory Technology American Association of Bioanalysts 27 appointed from a list of three names submitted by the Louisiana Hospital 28 Association. 29 (j) One consumer member selected from the state at large. SB NO. 506 SLS 18RS-1842 ORIGINAL 1 (2) Each clinical laboratory personnel member of the committee enumerated 2 in Subparagraphs (a) through (d) (e) of Paragraph (1) shall be appointed from four 3 five respective lists of six eight names each compiled by the submission of two 4 names from each of the following three four organizations: 5 * * * 6 (d) The American Association of Bioanalysts, for nomination of a 7 Louisiana member. 8 (3) The initial appointments shall include eight individuals eligible for 9 licensure under this Part. Each member appointed to the committee shall be a 10 resident of this state and shall have been actively engaged in the practice of clinical 11 laboratory science in his field of specialty or clinical laboratory science education 12 for five years immediately prior to appointment. After January 1, 1995, all All 13 clinical laboratory personnel appointed to the committee shall be licensed under this 14 Part. 15 D. The initial members of the committee shall be appointed no later than 16 October 1, 1993. If any of the designated associations fail to submit a list of 17 nominees by September 1, 1993, the board or governor shall appoint the respective 18 member of the committee without the nomination list established by this Section. 19 E. Initial appointments to the committee shall be for terms as follows: the two 20 physicians, two clinical laboratory scientist-generalists, one laboratory assistant, and 21 the hospital administrator shall be appointed for two years; two clinical laboratory 22 scientist-generalists and one clinical laboratory scientist-specialist, one clinical 23 laboratory scientist-technician and the cytotechnologist shall be appointed for one 24 year. Thereafter, a member Appointees shall serve for a three year three-year term. 25 No member shall serve more than two consecutive three year three-year terms. No 26 two members who are employed in the same clinical laboratory shall serve 27 concurrently. 28 F.E. Any vacancy occurring in the membership of the committee shall be 29 filled for the unexpired term in the same manner as the original appointment. The board may remove any member for misconduct, incompetence, or 2 neglect of duty, after a hearing and upon the recommendation by a majority vote of 3 the committee and the board. 4 H.G. The committee shall hold its initial meeting no later than December 1, 5 1993, and shall meet at least semi-annually thereafter, on a date and at a time and 6 place as it may designate. The committee may meet at such other times as deemed 7 necessary by the chairman or by the majority of its members. Reasonable notice of 8 all meetings shall be given in the manner prescribed by the committee. Six Eight 9 voting members of the committee shall constitute a quorum at any meeting for the 10 transaction of business. 11 I.H. At the initial meeting of the committee Annually, the committee shall 12 elect from its membership a chairman and such other officers as it deems necessary 13 to carry out the duties and functions of the committee. The board member sitting on 14 the committee shall not be eligible to serve as an elected officer of the committee. 15 Each officer shall serve a one year one-year term. In the event an officer is unable 16 to complete his term, the chairman shall appoint a successor to fill the unexpired 17 term. Thereafter, the committee shall elect officers annually. 18 J.I. Each member of the committee shall receive reimbursement for actual 19 expenses and mileage at the same rate set by the division of administration for state 20 employees under the provisions of R.S. 39:231, for each day in actual attendance at 21 committee meetings or for representing the committee in an official 22 committee-approved activity. 23 Section 2. Proposed law adds two gubernatorial appointment positions for a clinical laboratory scientist-generalist who does not have higher than an associate degree, and a consumer member. Proposed law adds the American Association of Bioanalysts as a nominating organization submitting names of clinical scientist-specialists to the governor. Present law provides for initial appointments to the committee. Proposed law repeals these provisions. Effective August 1, 2018.
