2018 Regular Session ENROLLED SENATE BILL NO. 506 BY SENATOR MILLS 1 AN ACT 2 To amend and reenact the introductory paragraph of R.S. 37:1314(B), the introductory 3 paragraph of (C)(1), (1)(h), (C)(3), and (D), (E), (F), (G), (H), and (I), to enact R.S. 4 37:1314(C)(1)(i) and (j), and to repeal R.S. 37:1314(J), relative to the Clinical 5 Laboratory Personnel Committee of the Louisiana State Board of Medical 6 Examiners; to provide for committee membership; to repeal provisions relative to the 7 initial appointment of committee members; and to provide for related matters. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. The introductory paragraph of R.S. 37:1314(B), the introductory 10 paragraph of (C)(1), (1)(h), (C)(3), and (D), (E), (F), (G), (H), and (I) are hereby amended 11 and reenacted and R.S. 37:1314(C)(1)(i) and (j) are hereby enacted to read as follows: 12 ยง1314. Clinical Laboratory Personnel Committee; creation; membership; 13 qualification; appointment; term; vacancy; officers; meetings; 14 reimbursement 15 * * * 16 B. The committee shall consist of twelve fourteen members. The board shall 17 appoint four members of the committee, subject to Senate confirmation, as follows: 18 * * * 19 C.(1) The governor shall appoint eight ten members of the committee, 20 subject to Senate confirmation, as follows: 21 * * * 22 (h) One laboratory assistant who shall be a member of the International 23 Society for Clinical Laboratory Technology American Association of Bioanalysts 24 appointed from a list of three names submitted by the Louisiana Hospital 25 Association. 26 (i) One individual who is an administrator of a Louisiana community and ACT No. 390 Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 506 ENROLLED 1 technical college appointed from a list of names submitted by the Louisiana 2 Community and Technical College System. 3 (j) One individual who is an educator in a clinical laboratory science 4 program from a two or four year program appointed from a list of names 5 submitted by the Board of Regents. 6 * * * 7 (3) The initial appointments shall include eight individuals eligible for 8 licensure under this Part. Each clinical laboratory personnel member appointed to 9 the committee shall be a resident of this state and shall have been actively engaged 10 in the practice of clinical laboratory science in his field of specialty or clinical 11 laboratory science education for five years immediately prior to appointment. After 12 January 1, 1995, all All clinical laboratory personnel appointed to the committee 13 shall be licensed under this Part. 14 D. The initial members of the committee shall be appointed no later than 15 October 1, 1993. If any of the designated associations fail to submit a list of 16 nominees by September 1, 1993, the board or governor shall appoint the respective 17 member of the committee without the nomination list established by this Section. 18 E. Initial appointments to the committee shall be for terms as follows: the two 19 physicians, two clinical laboratory scientist-generalists, one laboratory assistant, and 20 the hospital administrator shall be appointed for two years; two clinical laboratory 21 scientist-generalists and one clinical laboratory scientist-specialist, one clinical 22 laboratory scientist-technician and the cytotechnologist shall be appointed for one 23 year. Thereafter, a member Appointees shall serve for a three year three-year term. 24 No member shall serve more than two consecutive three year three-year terms. No 25 two members who are employed in the same clinical laboratory shall serve 26 concurrently. 27 F.E. Any vacancy occurring in the membership of the committee shall be 28 filled for the unexpired term in the same manner as the original appointment. 29 G.F. The committee shall hold its initial meeting no later than December 1, 3 1993, and shall meet at least semi-annually thereafter, on a date and at a time and 4 place as it may designate. The committee may meet at such other times as deemed 5 necessary by the chairman or by the majority of its members. Reasonable notice of 6 all meetings shall be given in the manner prescribed by the committee. Six Seven 7 voting members of the committee shall constitute a quorum at any meeting for the 8 transaction of business. 9 I.H. At the initial meeting of the committee Annually, the committee shall 10 elect from its membership a chairman and such other officers as it deems necessary 11 to carry out the duties and functions of the committee. The board member sitting on 12 the committee shall not be eligible to serve as an elected officer of the committee. 13 Each officer shall serve a one year one-year term. In the event an officer is unable 14 to complete his term, the chairman shall appoint a successor to fill the unexpired 15 term. Thereafter, the committee shall elect officers annually. 16 J.I. Each member of the committee shall receive reimbursement for actual 17 expenses and mileage at the same rate set by the division of administration for state 18 employees under the provisions of R.S. 39:231, for each day in actual attendance at 19 committee meetings or for representing the committee in an official 20 committee-approved activity. 21 Section 2. R.S. 37:1314(J) is hereby repealed.
